On the Government Information Portal, Ms. D.T.T.M in Hanoi asked that her family's land is in the detailed planning of Bac Co Nhue - Chem 1/500 approved by competent authorities, the land plot is in accordance with the residential land planning.
Ms. M asked, is her family's land exempt from a license to build an individual house under 7 floors?
The Ministry of Construction responds to this issue as follows:
According to current regulations at Point h, Clause 2, Article 89 of the 2014 Construction Law (amended and supplemented according to the provisions of Clause 30, Article 1 of Law No. 62/2020/QH14 amending and supplementing a number of articles of the Construction Law), amended and supplemented at Point c, Clause 1, Article 56 of the 2025 Railway Law, the project is exempted from a construction permit:
"The project under the construction investment project has been appraised by a specialized construction agency and the feasibility study report for construction investment in an area with a detailed planning at a scale of 1/500 or urban design approved by a competent authority".
Therefore, in the case of individual houses belonging to urban area construction investment projects, housing construction investment projects with detailed planning 1/500 approved by competent state agencies and appraised by specialized construction agencies for construction investment feasibility study reports, they are subject to exemption of construction permits according to regulations.
For the case of individual houses mentioned by Ms. M, if they are not exempted from the construction permit as above, they must have a construction permit according to the provisions of Clause 1, Article 89 of the 2014 Construction Law, amended in Clause 30, Article 1 of Law No. 62/2020/QH 14.
