In case of issuing and exchanging the issued Certificate, the implementation period is as follows:
- In the case specified in Points a, b, c, d, dd, e and g, Section 1, Part VII of "Part C. Procedures for registration of land and assets attached to land" is not more than 05 working days;
- In case specified in Point h, Section 1, Part VII of "Part C. The order and procedures for registering land and assets attached to land shall not exceed 10 working days, except for the case specified in Point c, Section 3 above;
- In case of simultaneous issuance of land use fees to multiple land users due to cadastral survey and maps, the implementation time according to the project has been approved by the competent authority.
In case of land division or land consolidation as prescribed in Part I of "Part C. Procedures for land registration and assets attached to land" and the case specified in Point b, Clause 6, Article 25, Decree No. 101/2024/ND-CP, the time limit shall not exceed 12 working days.
In case of reissuance of the issued Certificate due to loss, the time limit for posting the notice of loss of the issued Certificate at the People's Committee at the commune level and the time of posting on mass media is not counted.
In case of registration and issuance of Certificates of land use rights and ownership of assets attached to land to transferees of land use rights, house ownership rights, construction works, and construction items in real estate projects, the time limit shall not exceed 08 working days.
In case of re-determination of residential land area, it is not more than 20 working days; in case of registration and issuance of Certificates as prescribed in Part XIII of "Part C. Procedures for registration of land and assets attached to land" and the land user does not need to re-determination of residential land area, it is not more than 15 working days.
In case of correcting the issued Certificate, the time limit shall not exceed 08 working days.
In case of revocation and cancellation of the issued Certificate, the time limit for revocation of the issued Certificate is no more than 25 working days; in case of revocation of the first issued Certificate, the time for registration and re-issuance of the Certificate of land use rights and ownership of assets attached to land shall be according to the provisions of Section 1, Part II; in case of revocation of the issued Certificate due to registration of changes, the time for re-issuance of the Certificate of land use rights and ownership of assets attached to land shall be according to the provisions for each case of registration of changes in this Part II.
The time specified in Sections 1, 2, 3, 4, 5, 6, 7, 8 and 9, Part II is calculated from the date of receipt of the dossier that has been fully guaranteed; not including the time for the competent authority to determine the financial obligations on land, the time for performing the financial obligations of the land user, the time for considering handling cases of land use in violation of the law, the time for requesting appraisal, the time for public posting, posting information on mass media, the time for carrying out procedures for dividing inheritance of land use rights and assets attached to land in cases of carrying out procedures for granting a Certificate of land use rights and ownership of assets attached to land in which the land user or owner of assets attached to land died before granting the Certificate.
For mountainous communes, islands, remote areas, areas with difficult socio-economic conditions, areas with especially difficult socio-economic conditions, the implementation time for each type of procedure specified in Part II will be increased by 10 working days.
The agency handling administrative procedures specified in this Decree is responsible for handling no more than the prescribed time by its agency, and is not responsible for handling administrative procedures at other agencies.
The time for simultaneous implementation of many procedures for registration of land and assets attached to land is decided by the Provincial People's Committee but does not exceed the total time for implementation of each such procedure.
In case the investor of a real estate business project needs to submit multiple documents for registration and issuance of Certificates of land use rights and ownership of assets attached to land at the same time, the Provincial People's Committee shall consider and decide on the time to handle administrative procedures but ensure that it is not more than the time to handle each procedure for each dossier as prescribed in Part II.
