The Ministry of Agriculture and Environment received a petition from voters in Vinh Long province with the content: Currently, people want to implement land consolidation for agricultural land but encounter difficulties and cannot implement it due to different land use terms because according to the provisions of the Law, land consolidation is not allowed, it is proposed to have solutions to remove obstacles. At the same time, it is proposed to simplify administrative procedures in issuing land use right certificates because currently, to separate land plots, it is mandatory to switch to pink books to separate land plots, causing difficulties for people.
Regarding this proposal, the Ministry of Agriculture and Environment has the following opinions:
- To continue to remove obstacles and create favorable conditions for people, Clause 3, Article 11 of Resolution No. 254/2025/QH15 dated December 11, 2025 of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in the organization of the implementation of the Land Law has amended Article 220 of the 2024 Land Law to create more favorable conditions for land users; accordingly, the regulations on land consolidation have been amended in the direction of merging land plots that are not compulsory for the same land use term.
- Based on the provisions of point b, clause 3, section I, content C, part V, Appendix I issued together with Decree No. 151/2025/ND-CP, a Certificate of Land Use Rights issued without a land plot diagram or a land plot diagram but lacking the dimensions of the edges or the area and dimensions of the edges are not consistent, the new land user must register land changes before carrying out land plot separation and consolidation; this regulation aims to protect the legitimate rights and interests of land users and avoid arising land disputes after land plot separation and consolidation.
Thus, according to current land law, there is no regulation "if you want to separate plots, you must switch to pink books to be able to separate plots" as voters reflected.
