In March 2026, Mr. Nguyen Long Bien - Standing Vice Chairman of Khanh Hoa Provincial People's Committee signed a document approving Hong Ngoc Viet Tourism Investment Joint Stock Company to extend the land use progress at this project.
The reason for the extension is that the enterprise is behind the land use progress compared to the progress recorded in the investment project.
This content was identified in the 2023 Inspection Conclusion of the Department of Natural Resources and Environment of Khanh Hoa province, belonging to the case of violation of Clause 8, Article 81 of the 2024 Land Law.
The area extended for land use progress is 162,549.8m2, according to the Certificate of land use rights, ownership of houses and other assets attached to land issued under No. BL 037251 issued by Khanh Hoa Provincial People's Committee on November 8, 2012.
The extension of the above project has some grounds, including the Central Government's guidelines related to mechanisms and policies on real estate.
Decree No. 49 of 2026 of the Government detailing and guiding a number of articles of Resolution No. 254 of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in the organization of the implementation of the Land Law.
In addition, Khanh Hoa province also based on Decree No. 50 of 2026 of the Government detailing a number of articles of Resolution No. 254 of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law on land use fees and land rents;
According to research, the Nha Trang Seahorse Resort & Spa resort project has been handed over land on the ground by Khanh Hoa Provincial People's Committee to the investor since 2018 to deploy construction.
According to the Investment Registration Certificate, the project must complete many items in 2018 and 2019.
Specifically, before July 1, 2018, the investor must complete and put into use 46 bungalows, build a 15-story hotel base block and technical infrastructure system.
Next, before September 30, 2018, the project must complete the rough construction of the spa service area, central restaurant and landscape bridge.
All remaining items of the project must be completed and put into operation before December 31, 2019.
However, to date, the project has not been completed according to the progress approved in the Investment Registration Certificate, leading to the need to consider extending the land use progress according to legal regulations.
