Responding to the Government's Electronic Information Portal, a reader in Nam Dinh said that the locality has reclaimed rice-growing land to implement residential projects and auction land use rights.
The reader's family of 6 people (a grandmother and 4 children) is divided into land corresponding to 3.6 sounds in the North.
The eldest son's family (with 4 members) and the daughter's family (with 4 members) are both farmers who have been cultivating the entire area of the fields since 2010.
However, when the land was reclaimed, no family member was supported to stabilize their lives.
The People's Committee of the commune replied that because the red book was in the name of the grandparents, in 2019, the reader's grandmother passed away and the reader's grandfather also passed away in 2024, now the land is reclaimed without any residents, so they are not entitled to support.
A reader asked, the red book is in the name of the household, according to the land division standard, the old couple cannot own 3.6 sounds of rice fields. So when considering the members who own the land of the household, why are the 4 children who are divided into plots of land not considered for support to stabilize their lives?
Referring to this content, the Ministry of Agriculture and Environment replied that in Clause 1, Article 19 of Decree No. 88/2024/ND-CP dated July 15, 2024 of the Government regulating compensation, support, and resettlement when the State reclaims land, it is stipulated that households and individuals currently using agricultural land who are eligible for land compensation will be supported to stabilize their lives as follows:
Recovering from 30% to 70% of agricultural land in use will be supported for 6 months if there is no need to relocate and for 12 months if there is a need to relocate;
In case of having to move to an area with difficult socio-economic conditions or with particularly difficult socio-economic conditions, the maximum support period is 24 months.
In case of recovery of over 70% of agricultural land in use, support will be provided within 12 months if there is no need to relocate and within 24 months if there is a need to relocate;
In case of having to move to an area with difficult socio-economic conditions or with particularly difficult socio-economic conditions, the maximum support period is 36 months;
The area of recovered agricultural land to calculate the stabilization of life is the area within the commune, ward, or town where the land is recovered at the time of the decision approving the compensation, support, and resettlement plan and is determined according to each project that must be recovered by the People's Committee at the competent level, without accumulating the area of recovered agricultural land of previous land recovery projects;
The support level for a given population is calculated in cash equivalent to 30kg of rice in 1 month according to the average price at the time of support of the locality.
