(1) Cases of issuing and exchanging red books include:
- Land users who need to change the Certificate issued before August 1, 2024 to a Certificate of land use rights and ownership of assets attached to land;
- The issued certificate is stained, blurred, torn, or damaged;
- Certificates issued together for many plots of land but issued separately for each plot of land according to the needs of land users and cases of issuance and exchange of Certificates of land use rights and ownership of assets attached to land as prescribed in Section 7, Part XV of Appendix I issued with Decree 151/2025/ND-CP
- The purpose of land use stated on the issued Certificate according to the provisions of the law on land at the time of issuance of the issued Certificate is different from the purpose of land use according to land classification
- The location of the land plot on the issued Certificate is not accurate compared to the actual location of land use at the time of issuance of the issued Certificate;
- Land use rights, ownership rights of assets attached to land are common property of the husband and wife, but the issued Certificate only records the full name of the wife or husband, now there is a requirement to reissue the Certificate of land use rights, ownership rights of assets attached to land to record the full name, wife and family name, husband's name;
- The issued certificate records the household name, now members sharing the land use rights of that household request to issue and renew the Certificate of land use rights and ownership of assets attached to the land to record the full names of members sharing the land use rights of the household;
- Change the size of edges, areas, and numbers of land plots due to land survey and cadastral survey of land plots without changing the land plot boundary.
(2) Details of procedures for issuing and exchanging red books
- Land users, owners of assets attached to land submit the prescribed dossier (3) to the One-stop Department or the Land Registration Office or Branch of the Land Registration Office;
- The dossier receiving agency:
+ Check the completeness of the dossier and issue a dossier receipt and schedule a return of results.
In case the documents are not complete, the documents must be returned with the Supplement and Complete Application Form so that the applicant can register to complete and supplement according to regulations.
- In case the dossier receiving agency is the One-stop Department, the dossier shall be transferred to the Land Registration Office.
(3) Documents to submit when carrying out procedures for granting and exchanging red books:
- Application for registration of changes in land and assets attached to land according to Form No. 18 and the issued Certificate.
In the case of a red book that has been issued to record the name of a household, now members sharing the land use rights of that household request to issue and renew the Certificate of land use rights and ownership of assets attached to the land to record the full names of members, the Application for registration of changes in land and assets attached to land must include information about members sharing the land use rights of the household;
- Land plot cadastral map measurement for land plot cadastral measurement cases specified in Point h, Section 1, Part VII of Appendix I issued with Decree 151/2025/ND-CP and cases specified in Points a, b, c, d, dd, e and g, Section 1, Part VII of Appendix I issued with Decree 151/2025/ND-CP that land users need to measure to re-determine the size of the edges and area of the land plot.
