The Government has just issued Decree 151/2025/ND-CP regulating the division of authority of local authorities at 2 levels, decentralization of authority, and delegation of authority in the land sector.
Accordingly, the authority of the District People's Committee and the Chairman of the District People's Committee will be transferred to the Chairman of the Commune People's Committee for the following contents: approval of the agricultural land use plan of an economic organization; the rice land use plan of individuals; land recovery decision; compensation and resettlement support plan, enforcement plan, land price, resettlement housing sale price.
Notably, according to the decree, from July 1, the Chairman of the People's Committee at the commune level will be granted a certificate of land use rights and ownership of assets attached to land (red book) for the first time to the people.
At the same time, the commune level is granted a red book according to the approved land use rights contribution and land adjustment plan. This task is currently undertaken by the provincial and district levels.
Cases of granting red books under the authority of the Provincial People's Committee will be assigned to communes, wards and special zones, including: granting red books to domestic organizations such as state agencies, Party agencies, armed forces units, the Fatherland Front, socio-political organizations, public service units; religious organizations; foreign organizations with diplomatic functions; people of Vietnamese origin residing abroad; economic organizations with foreign investment capital.
In addition, a series of other powers are transferred from the district level to the Chairman of the People's Committee at the commune level, such as: approving the agricultural land use plan of an economic organization; approving the rice land use plan of individuals; land recovery; approving compensation, support and resettlement plans; approving the enforcement and funding plan for enforcement activities; deciding on specific land prices; deciding on resettlement housing prices in the area.
The Chairman of the People's Committee at the commune level established a Land Price Appraisal Council as well as a decision on land allocation, land lease, and permission to change the purpose of land use for individuals, previously under the authority of the provincial level.
Previously, on June 12, Politburo member and Permanent Deputy Prime Minister Nguyen Hoa Binh chaired a conference to announce 28 decrees on decentralization and delegation of authority; decentralization of authority between the Government and local governments at both levels.
The National Assembly also passed a Resolution on the arrangement of provincial-level administrative units in 2025, reducing the number of provinces and cities from 63 to 34. After the arrangement, there are 3,321 communes, wards and special zones nationwide.
