Pursuant to Point b, Clause 1, Article 39 of Circular 10/2024/TT-BTNMT, the following cases are not shown in the land plot diagram:
- Certificates issued for many agricultural land plots;
- Certificate issued to agricultural and forestry companies, except in cases where the land plot is used for the purpose of building the company's headquarters;
- Certificate issued for the entire land area to implement a real estate project;
- Formed geographical objects. For example: "Traffic roads, power lines, water lines of investment organizations built under the BOT form".
In addition, according to Point b, Clause 3, Article 7 of Decree 101/2024/ND-CP, it is stipulated that:
- The Land Registration Office or a Branch of the Land Registration Office checks the records and compares them as prescribed in Article 220 of the Land Law to determine the conditions for land division and consolidation; checks information about the land user, boundary, area, and type of land of the land plots on the archival records and records submitted by the land user and performs as follows:
+ In case the dossier is eligible for land division or consolidation but the issued Certificate does not have a land plot diagram or has a land plot diagram but the edges are missing or the area and edges are not unified, within 3 working days from the date of receipt of the complete dossier, the Land Registration Office, the Branch of the Land Registration Office will return the dossier and clearly notify the land user of the reason for registering land changes;
It can be seen that there are some cases where there is no need for a land plot diagram on the red book according to the above regulations.
However, if you want to carry out the land division procedure but the red book does not have a land plot diagram, within 3 working days from the date of receipt of the complete dossier, the Land Registration Office, the Branch of the Land Registration Office will return the dossier and clearly notify the land user of the reason for registering land changes.
Therefore, when carrying out procedures related to land without a land plot diagram in the red book, the land user needs to carry out additional procedures for registering land changes.
