Chuyen My commune is implementing a 30-day campaign to review and remove "T" data for free for the people.
The campaign aims to re-determine the area of residential land according to the land allocation dossier and the land use right certificate (also known as the red book) issued, ensuring accuracy and transparency in land management in the commune.
The deletion of the letter T will help people fully exercise their legitimate rights such as: Inheritance, donation, transfer, mortgage of land use rights and other civil transactions related to land.
Handling directions for red books with the letter "T
Previously, voters in Dai Xuyen commune proposed that the Hanoi City People's Committee guide the handling of land use right certificates issued after July 1, 2004 but still stating the purpose of use as "T".
For these cases, voters proposed to clarify the content: Is it possible to consider and resolve according to the procedure to re-determine the residential land area for land plots with gardens, ponds, and residential land that were granted certificates before July 1, 2004 when land users have needs or when the State recovers land according to Clause 6, Article 141 of the 2024 Land Law or not.
Regarding this content, the Hanoi People's Committee said that it has received voters' petitions.
The City People's Committee assigned the Department of Agriculture and Environment to guide localities to implement and inform voters in July 2026.
Is the letter "T" residential land or cultivated land?
Voters in Phuong Cach 4 village, Quoc Oai commune, also once proposed that the city consider unifying the explanation and clearly stipulate the classification of land with the letter "T" in people's land use right certificates. Previously, when issuing land use right certificates, people were explained that the letter "T" was residential land. Currently, when people exchange land use right certificates, separate plots... they are again explained that the letter "T" is cultivated land.
Regarding the content reflected by voters, the Hanoi People's Committee said that according to the provisions of Decision No. 56-ĐKTK dated November 5, 1981 of the General Department of Land Administration on procedures for registering and statistics of land plots nationwide, the type of land plot recorded in the land registration book and inventory book is shown in symbols according to the regulations in the land plot statistical summary.
The type of land with the symbol "T" of the field and land statistical summary issued together with Decision No. 56-ĐKTK is identified as "land in residential areas" - which is land for construction in urban and rural residential areas, except for soil cultivation, ponds, lakes, roads in villages that have been measured and separated; including residential land and land for construction of works serving the interests of the entire people in the fields of culture, health education, sports, resorts, tourism; headquarters of agencies, unions, religions, warehouses, agricultural and forestry facilities such as livestock barns, repair stations...
According to Decision No. 237/QD-LB dated August 3, 1989 of the Inter-General Department of Land Administration and the General Statistics Office, the type of "land in residential areas" was previously regulated to be separated into the types of "land in residential areas" (including urban residential land and rural residential land) and "specialized land" (including construction land, road traffic land, irrigation land...) with codes and symbols for land statistics and inventory.
On August 26, 1993, the General Department of Land Administration issued Official Dispatch No. 547/DC directing the temporary application of regulations on establishing cadastral maps, and on July 27, 1995, the General Department of Land Administration issued Decision No. 499/QD-DC stipulating the model of cadastral book, land inventory book, land use right certificate book, land movement monitoring book. In which, regulations on land types with "residential purposes" symbolized by the letter "T", building each type of project with its own symbol.
Regarding the land type symbol "T" when implementing the 1993 Land Law, Decision No. 499/QD-DC dated July 27, 1995 of the General Department of Land Administration promulgating regulations on model land registers, land inventory books, books for issuing Certificates of Land Use Rights, land movement monitoring books, the land type "T" is determined to be "for residential purposes". However, there is no specific conclusion on whether the content of the land type symbol (the word "T") on the issued certificates is the entire residential land or not.
On January 31, 2026, the Government issued Decree No. 49/2026/ND-CP detailing and guiding a number of articles of Resolution No. 254/2025/QH15 of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law, accordingly, in Clause 2, Article 20 of Decree No. 49/2026/ND-CP dated January 31, 2026 of the Government, the settlement of land use right certificates issued before July 1, 2004 is not subject to the cases specified in Clause 6, Article 141 of the Land Law and has not specifically determined the residential land area but is shown as common residential land with other land, such as "residential land", "concentrated land", "housing land", "residential land + garden", "T", "TV", "TQ", "TTT".
From the above reality, voters are requested to base on dossiers, land use papers, and the process of managing and using land to determine the specific residential land area on the issued certificate. When land users carry out procedures to register land changes, the competent authority issuing the certificate of land use rights and ownership of assets attached to land is responsible for simultaneously determining the specific residential land area.
In case land users have a need to carry out separate procedures to determine the area of residential land, they shall carry out according to the order and procedures for determining the area of residential land" - the Department of Agriculture and Environment informed.
