According to voters' reflections, when red books are issued, many households are explained that the symbol "T" is residential land. However, currently when people exchange books, separate plots... they explain that the letter "T" is cultivated land.
Answering voters' petitions, the Hanoi City People's Committee said that, according to the provisions of Decision No. 56-ĐKTK dated November 5, 1981 of the General Department of Land Administration promulgating regulations on procedures for registering land statistics nationwide, the type of land recorded in the land registration book and inventory book is shown in symbols as prescribed in the land statistics summary.
The type of land marked with the letter "T" of the land plot statistical summary issued together with Decision No. 56-ĐKTK is identified as "land in residential areas" - which is land for construction in urban and rural residential areas, except for soil cultivation, ponds, lakes, and roads in villages that have been measured and separated.
Including residential land and land for building works serving the interests of the entire people in the fields of culture, health education, sports, resorts, tourism; headquarters of agencies, unions, religions, warehouses, agricultural and forestry facilities such as livestock barns, repair stations...
From October 12, 1989, the land area statistics were re-regulated according to Decision No. 237/QD-LB dated August 3, 1989 of the Inter-General Department of Land Administration and the General Statistics Office.
In which, the type of "residential land area" was previously regulated to be separated into the types of "residential land area" (including urban residential land and rural residential land) and "specialized land" (including construction land, traffic road land, irrigation land...) are specified with codes to serve land statistics and inventory.
On August 26, 1993, the General Department of Land Administration issued Official Dispatch No. 547/DC directing the temporary application of regulations to create cadastral maps, and on July 27, 1995, the General Department of Land Administration issued Decision No. 499-QD/DC stipulating the model of cadastral books, land registers, land use right certificates, land change monitoring books; in which, regulations on land types with "residential purposes" symbolized by the letter "T", building each type of project with separate symbols.
For the land type "T" symbol when implementing the 1993 Land Law, Decision No. 499/QD-DC of the General Department of Land Administration, the land type "T" is determined to be "for residential purposes".
However, there is no specific conclusion on whether the land type symbol (the letter "T") on the issued certificates is the entire residential land or not?
Therefore, on January 31, 2026, the Government issued Decree No. 49/2026/ND-CP detailing and guiding a number of articles of Resolution No. 254/2025/QH15 of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law.
Accordingly, Clause 2, Article 20 of Decree No. 49/2026/ND-CP dated January 31, 2026 of the Government has stipulated the settlement for Certificates of land use rights issued before July 1, 2004 that do not fall into the cases specified in Clause 6, Article 141 of the Land Law and have not specifically determined the area of residential land but are shown as common residential land with other land, such as "residential land", "central residential land", "housing land", "residential land + garden", "T", "TV", "TQ", "TTT".
From the above reality, the Hanoi People's Committee requests voters to base on dossiers, land use papers, and the process of management and use of land to determine the specific residential land area on the issued certificate; when land users carry out procedures to register land changes, the competent authority issuing the certificate of land use rights and ownership of assets attached to land is responsible for simultaneously determining the specific residential land area.
In case land users need to carry out separate procedures to determine the area of residential land, they shall carry out according to the order and procedures for determining the area of residential land.
Recently, the People's Committee of Chuyen My commune (Hanoi) issued a notice on the implementation of the 30-day campaign to review and remove free "T" data for people on land use right certificates (also known as red books) that have been issued.
According to the People's Committee of Chuyen My commune, the removal of the "T" will help people fully exercise their legitimate rights such as: Inheritance, donation, transfer, mortgage of land use rights and other civil transactions related to land.
