The Handbook guiding state management in the land sector when implementing the two-level local government of the Ministry of Agriculture and Environment clearly stipulates the authority and tasks of the Chairman of the People's Committee at the provincial level.
Notably, the Chairman of the Provincial People's Committee is allowed to decide on the selling price of resettlement housing in cases of resettlement housing arrangement in commune-level areas other than commune-level areas with recovered land as prescribed in Clause 3, Article 111 of the Land Law.
(Clause 3, Article 111 of the Land Law: Land price for calculating land use fees at resettlement places for people compensated for residential land, people allocated resettlement land in cases where they do not meet the conditions for compensation for residential land is the land price determined according to the land price list at the time of approving the compensation, support and resettlement plan. In addition, the Chairman of the Provincial People's Committee is allowed to record land prices in the decision on land allocation, land lease, permission to change land use purposes, extend land use, adjust land use term, change land use forms under the authority of the Chairman of the Provincial People's Committee in cases of applying land prices in the land price list to calculate land use fees and land rent.
Issuing a land price decision under the authority of the Chairman of the Provincial People's Committee for the case of determining specific land prices as prescribed in Clause 4, Article 155 of the Land Law.
The Chairman of the Provincial People's Committee also decides on specific land prices for land allocation and lease, permission to change land use purposes, recognition of land use rights, extension of land use, adjustment of land use term, adjustment of detailed construction planning, land recovery, determination of starting price for land use rights auction, determination of land use right value when equitizing enterprises under the authority of the Provincial People's Committee.
