To determine the area of resettlement land when the State reclaims land, there is no general answer for all cases. Depending on the specific compensation, support and resettlement plan, the resettlement land area for each case can be determined.
Accordingly, Clause 1, Article 3 of Decree 88/2024/ND-CP on the content of compensation, support and resettlement plans contains detailed plans on compensation, support and resettlement for each person whose land is recovered or property owner.
In particular, the detailed plan for compensation, support, and resettlement for each person whose land is recovered, and property owner includes the following contents:
- Full name, personal identification number, address (current permanent residence and residence), phone number of the person whose land is recovered, property owner (if any).
- Location, area, type of land, origin of recovered land.
- type of property, quantity, volume of property; remaining quality of damaged houses and construction works.
- Land and property prices for compensation.
- Support items: stabilization support for life (population supported, support level, support time); support for stable production and business; support for livestock relocation; support for training, job conversion and job search (supported land area, supported land price); resettlement support; support for demolition, demolition, relocation; other support items (if any).
- Total compensation and support: compensation for land, compensation for assets, compensation for property relocation costs, compensation for remaining investment costs on land, support.
- Location, area, land use fee when allocating resettlement land, resettlement housing sale price to resettled people or allocating other land to households and individuals (if any).
- Location and area of land when allocating or leasing land with the same purpose of use as the type of land recovered for an organization; leasing land with the same purpose of use as the type of land recovered for households and individuals (if any).
- Location, area, land use fee when compensation in land with a purpose of use other than the type of recovered land or in housing for households and individuals (if any).
- The amount of money that has not fulfilled financial obligations regarding land (if any).
- The total compensation and support amount received after deducting land use fees and land rents must be included in the land compensation amount (if any).
- The amount of money to be recorded as debt for land use fees when being allocated resettlement land (if any).
In other words, depending on the specific resettlement plan, there will be different resettlement areas.
