On the Ministry of Construction's Information Portal, reader N.Q. H wondered:
My wife and I are currently living in rent and were given a piece of land by my parents-in-law in the area where we are living and there is a project to open for sale social housing. There is no house on the land and no housing information on the land register. According to Decree No. 54/2026/ND-CP dated February 9, 2026, the case of not having a house is determined to be that there is no name or no housing information on the Certificate of Land Use Rights.
So, can I register to buy social housing? And as it is now, land registration offices only confirm whether or not there is a name on the Certificate of Land Use Rights, but do not confirm whether or not there is housing information on the Certificate of Land Use Rights?
Answering this content, the Department of Housing and Real Estate Market Management (Ministry of Construction) has the following opinions:
To be eligible to buy social housing, they must be eligible for social housing support policies and meet sufficient conditions (in terms of housing and income) according to the provisions of housing law, without stipulating conditions for residential land.
Articles 76 and 78 of the 2023 Housing Law stipulate the subjects and conditions to enjoy social housing support policies.
Article 32 of Decree No. 54/2026/ND-CP dated February 9, 2026 of the Government amending and supplementing a number of articles of Decrees in the field of housing and real estate business (has amended and supplemented Clause 1, Article 29 of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government) as follows:
“1. The case where there is no housing owned by them is determined when the subject specified in Clause 1, Article 77 of the Housing Law and the spouse of that subject (if any) are determined to have no name or no housing information content in the Certificate of land use rights, ownership of assets attached to land in the province or centrally-run city where that social housing project is located.
Within 7 days from the date of receiving the request for confirmation of housing conditions, the competent authority issuing the Certificate of land use rights, ownership of assets attached to land according to the provisions of land law in the province or centrally-run city where there is a social housing project certified according to the provisions of this clause".
Thus, the case of not having housing owned by oneself is determined when the subject and the spouse of that subject (if any) are determined to have no name or no housing information content in the Certificate of land use rights, ownership of assets attached to land in the province or centrally-run city where that social housing project is located.
Citizens are requested to study and implement according to regulations.
