The Ministry of Agriculture and Environment received a petition from Hai Phong voters with the content: Voters believe that, according to Clause 3, Article 172 of the 2024 Land Law, households and individuals renting land who need to extend land use rights must submit a request for extension at least 06 months before the expiration date. However, due to the merger of administrative units to implement the 02-level local government model, so far some cases have exceeded the deadline by 06 months or have expired the land use term but have not been extended land use rights (although land users use land for the right purpose of renting, and at the same time have the need to continue using land).
Voters proposed to submit to the Government for consideration and permission to apply this case as a "force majeure case" and issue guidance on extending land use rights for "force majeure cases" according to Clause 3, Article 172 of the 2024 Land Law.
Answering this content, the Ministry of Agriculture and Environment said:
Clause 3, Article 172 of the 2024 Land Law stipulates that land use extension is carried out in the last year of the land use term, except for the cases specified in point a, clause 1, Article 172 of the Land Law. Land users who need to extend land use must submit a request for extension at least 06 months before the end of the land use term. After the deadline for submitting a request for extension, if the land user does not submit a request for extension, land use extension is not allowed, except in force majeure cases.
In case land use extension is not allowed, competent state agencies shall carry out land recovery in accordance with the provisions of land law. The Ministry of Agriculture and Environment will continue to study in the process of perfecting land law related to cases of force majeure when extending land use as prescribed in Clause 3, Article 172 of the Land Law.
The decision on other cases of force majeure is under the authority of the Provincial People's Committee according to the decentralization of authority specified in Decree No. 151/2025/ND-CP.
