Kieu Phu Commune People's Committee has just issued a plan to organize land recovery coercion against 37 households in Ngoc Than village who did not comply with the land recovery decision to implement the project to prepare ground and build infrastructure for the Vietnam National Museum of Nature.
The organization of coercion to implement land recovery decisions according to the provisions of Article 89 of the 2024 Land Law; coercive land recovery decisions of the Chairman of Kieu Phu Commune People's Committee.
The enforcement of land recovery decisions is carried out publicly, transparently, democratically, objectively, ensuring order and safety in accordance with regulations, demonstrating the strictness of the law and the effectiveness and efficiency in administrative management and land management in the commune.
According to the Commune People's Committee, resolute and thorough handling will contribute to propaganda and education of law compliance awareness of households in general and for site clearance work in particular.
Accordingly, the commune organized the coercive recovery of 44 agricultural land plots with a total area of 76,764.8m2 of 37 households in Ngoc Than village.
From January 13 to January 14, implement coercion of land plots without construction works on land. From January 26 to January 30, implement coercion of land plots with construction works on land.
In case the person subject to coercion complies with the coercion decision, the Coercion Board shall carry out land recovery and make a record of compliance with the land handover, which shall be carried out no later than 30 days from the date of making the record.
In case the person being coerced does not comply with the coercion decision, the following steps shall be implemented:
- Representatives of the Investment - Infrastructure Project Management Board announced the enforcement decisions. Request forces and vehicles to enter the assigned task positions. (Note: As soon as forces arrive at the enforcement location, Thach That Power Company immediately disconnects the power of the enforcement area to ensure safety).
- The commune police force requests the person being coerced, those who are not responsible to leave the coercive area. Agencies and unions, according to their functions and tasks, propagate and explain issues arising to related citizens when there are questions. (In case people who are not responsible resist or do not comply, the police force has measures to remove people from the coercive area).
- The security and order assurance team conducts a final inspection on the issue of enforcement safety, the Commune Culture - Information and Sports Center records and photographs the enforcement process.
- Forces and vehicles participating in coercion shall carry out coercion according to assigned tasks and under the direction of the Head of the Coercion Board, specific instructions of the Vice Chairman of the Commune People's Committee and the Director of the Investment - Infrastructure Project Management Board.
- The land recovery coercion board directs relevant units to make records of inventory of assets on the coerced land plot (with recording, taking photos), seal assets and organize handover to the coerced person. In case the coerced person does not receive the property back, transport it to a designated place (make a record of receiving the property back or not receiving the property back from the coerced person).
- The construction unit is carrying out ground leveling.
- When the coercion is completed, the Head of the Coercion Board issues an order to stop the coercion. The Investment - Infrastructure Project Management Board shall prepare a Record of the status after coercion (with recording, taking photos); complete the Coercion Minutes, publicly announce the minutes and invite representatives of leaders of forces participating in coercion, coerced persons (if any) to sign the minutes, end the coercion. After the coercion ends, invite representatives of leaders and forces participating in coercion coordination to focus on moving to the Commune People's Committee to hold a meeting to draw experience.
