According to Point d, Clause 1, Clause 2 and Clause 3, Article 133 of the 2024 Land Law, land change registration is specifically regulated as follows:
1. Cases of registration of changes
Registration of changes is carried out in cases where one of the following types of certificates has been granted:
- Land use rights certificate;
- Certificate of house ownership and land use rights;
- Certificate of house ownership;
- Certificate of ownership of construction works;
- Certificate of land use rights, house ownership rights and other assets attached to land;
- Certificate of land use rights and ownership of assets attached to land.
Registration of changes is carried out when there are changes, including: Changes in boundaries, landmarks, side dimensions, area, number and address of the land plot.
2. Procedure for confirmation of registration of changes
The cases of registration of changes specified in Clause 1 of this Article shall be approved by the competent authority:
- Confirmation on the issued certificate; or
- Reissue certificates of land use rights and ownership of assets attached to land if land users and asset owners have a need.
Note: In case of registration of changes according to point p, clause 1 of this Article, it will only be confirmed on the issued certificate.
3. Deadline for mandatory change registration
Some cases of change registration must be made within 30 days from the date of change, including:
- The cases specified in points a, b, i, k, l, m and q, Clause 1 of this Article;
- In case of execution of judgment, the time limit is calculated from the date of handover of the property to be executed or the property to be auctioned;
- In case of inheritance of land use rights, the term is calculated from the date of completion of division of land use rights as inherited property or from the date the judgment or decision of the Court takes legal effect.
Thus, when arranging administrative units (or changing the address of a land plot), people are not required to carry out the registration procedure for changes within a certain period of time. Registration of changes and information changes is only carried out when the land user has a need.
