Ms. N.T.M.D in Ho Chi Minh City reflected that her neighbor registered to measure and edit the cadastral map with the reason of changing the land plot, the boundary of the plot changed compared to the cadastral map. This caused part of the land of Ms. D's house and another household to be merged into the original plot of the neighbor to form a new plot of land.
Ms. D asked, is it considered a sign of violation if the edited map was made to affect her family's land without anyone reporting it?
The Ministry of Agriculture and Environment responds to this issue as follows:
When issuing a Certificate (red book) in case of boundary changes, the People's Committee at the commune level shall publicly post the confirmation contents at the headquarters of the People's Committee at the commune level, residential area where the land and assets attached to the land are located within 15 days, and at the same time consider resolving opinions reflecting on the public content (if any).
In case she does not know the information about granting a Certificate to adjacent land users and granting a Certificate overlapping to her land plot, she has the right to complain and file a lawsuit against administrative decisions and administrative acts on land management according to the provisions of Article 237 of the Land Law and Article 7 of the 2011 Law on Complaints.
