Citizens asked the Ministry of Agriculture and Environment with the content: Many land plots left by their ancestors have not been granted a Certificate of Land Use Rights, now co-heirs have a need to separate plots and request to be granted Certificates for each person, ensuring the minimum area according to the regulations of the Provincial People's Committee. Please ask, in case the land plot does not have a Certificate, are the procedures for separating plots and issuing Certificates for each person carried out simultaneously?
Answering this content, the Ministry of Agriculture and Environment said:
Regarding the order and procedures for registration and issuance of Certificates of land use rights and ownership of assets attached to land for the first time, it is specified in Section II and Section V of Content C, Part V, Appendix I issued together with Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government regulating the decentralization of authority of local authorities at 2 levels, decentralization, and decentralization in the field of land, including cases of inheritance of land use rights.
The order and procedures for land plot separation and consolidation are specified in Section I, Content C, Part V, Appendix I issued together with Decree No. 151/2025/ND-CP.
In case the applicant has the need to simultaneously carry out many procedures for registering land and assets attached to land, the procedure handling agencies are responsible for inter-agency coordination with competent authorities to resolve according to the provisions of Clause 6, Article 18 of Decree No. 101/2024/ND-CP dated July 29, 2024 of the Government regulating basic land investigation; registration and issuance of Certificates of land use rights, ownership of assets attached to land and Land Information System.
The Ministry of Agriculture and Environment informs citizens to know and contact competent authorities to resolve in the locality for specific guidance.
