On October 11, the Government Inspectorate issued a document announcing the conclusion of the inspection of land use conversion and housing construction in the 2011-2019 period of state-owned enterprises and equitized enterprises.
In Binh Duong, there are 3 land plots mentioned in the Government Inspectorate's inspection conclusion. Notably, the 47,882m2 land plot (nearly 4.8ha) in Di An ward, Di An city, Binh Duong province. In 2018, Binh Duong Provincial People's Committee allowed Di An Railway Development Company Limited (in Decision No. 509/QD-UBND) to change the land use purpose and approved the investment policy (in Decision 2475/UBND-KTN) to implement the Railway Commercial Housing Extension project.
Di An Railway Development Company Limited signed a contract to raise capital for 290 plots of land, collecting about 231.8 billion VND. This illegal capital mobilization was administratively sanctioned by the Chairman of Binh Duong Provincial People's Committee, but the violation was not corrected.
By 2021, Binh Duong Provincial People's Committee revoked Decision No. 509/QD-UBND against Di An Railway Development Company Limited.
The conclusion of the Government Inspectorate stated that Di An Railway Development Company Limited had not been granted land use rights, had not had its investment project approved, had not been granted a construction permit, but had signed a capital mobilization contract. This was a serious violation of regulations on capital mobilization for commercial housing development.
Since 2018, Di An Railway Development Company Limited has not been permitted to carry out the project, but has raised capital and has not yet repaid customers a huge amount of money, still owing about 191.7 billion VND. This behavior shows signs of fraud and property appropriation, as stipulated in Article 174 of the 2015 Penal Code.
In addition, the capital mobilized from customers is not shown in the financial statements of the enterprise submitted to the Binh Duong Provincial Tax Department. This is a serious violation of the Accounting Law, with the risk of losing customers' contributed capital, and needs to be investigated and handled according to the provisions of law.
The Government Inspectorate requests the Ministry of Public Security to receive documents for review, investigation and handling according to the law for the above violations.
Previously, many people reported to Lao Dong Newspaper about the implementation of a capital contribution contract with Di An Railway Development Company Limited for the purpose of buying land to build houses in the above project.
Many people have spent billions of dong to contribute capital hoping to buy a 70m2 plot of land to build a house and settle down. However, after many years, they still have not received the land. As a result, people have fallen into difficult situations, having to rent for a long time, and saving to pay off the loan they contributed.
According to records, the land of nearly 4.8 hectares originally belonged to the Di An Railway Supply Station. There was a railway track running through the land. The tracks were then removed and leveled by relevant units, preparing the infrastructure to divide the plots into separate plots to implement the housing project.
Currently, the land is still vacant, overgrown with wild grass. Inside the land, rocks were poured to make roads, a drainage system was built.... Railway tracks are piled up at the edge of the land.
In addition to the above land, the Government Inspectorate's conclusion also pointed out similar violations in the 9.6ha land. This land has implemented the Di An railway commercial apartment and housing project.
Another adjacent land plot of 6.4 hectares has been divided into plots to implement a railway commercial housing project. Di An Railway Housing Development Company Limited has used the land to mobilize investment cooperation capital with 387 adjacent plots of land. Most of the people who contributed capital to buy the land have built houses.
