Sharing with Lao Dong reporter, Mr. Le Hoang Chau - Chairman of the Ho Chi Minh City Real Estate Association (HoREA) - said that the Association has sent a document to the Prime Minister and the Ministry of Natural Resources and Environment to comment on the Draft Decree detailing the implementation of the National Assembly's Resolution on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights.
The Association proposes to amend and supplement Clause 1 and Clause 2a (after Clause 2) Article 4 of the Draft Decree regulating the authority of the Ministry of National Defense and the Ministry of Public Security to appoint investors, to be allocated investment phases, to implement pilot projects, and to be approved for subjects eligible to buy, rent, or lease houses to the People's Armed Forces according to the provisions of the law on social housing.
Mr. Le Hoang Chau said that in the case of using areas of national defense land and security land that have been planned to be removed from national defense land and security land to implement a pilot project, the Ministry of National Defense and the Ministry of Public Security are allowed to appoint military and police enterprises (if any) or enterprises in economic sectors that are eligible to do real estate business according to the provisions of the Law on Real Estate Business as investors of the pilot project.
The Ministry of National Defense and the Ministry of Public Security are allowed to decide on investment phases, implement pilot projects in stages to suit investment resources and meet the housing needs of the people's armed forces in each period.
For the 20% of the total residential land area within the pilot project, which has been invested in building a technical infrastructure system to build social housing, after completion, the Ministry of National Defense and the Ministry of Public Security will be decided to approve the subjects eligible to buy, lease, and rent houses to the People's Armed Forces according to the provisions of the law on social housing.
In addition, the Association found that the appointment of investors to implement the pilot project in cases of using areas of national defense land and security land that have been planned to be removed from national defense land and security land aims to shorten the implementation time of administrative processes and procedures and in accordance with the pilot nature of the project.
At the same time, Resolution 171/2024/QH15 of the National Assembly approved the priority of assigning the Ministry of National Defense and the Ministry of Public Security to organize the implementation of the pilot project, so the Draft Decree of the Government may stipulate the assignment of the Ministry of National Defense and the Ministry of Public Security to appoint investors for the pilot project to suit the specific conditions of the armed forces, especially the specific conditions of the Ministry of Public Security.
Allowing the Ministry of National Defense and the Ministry of Public Security to allocate investment phases for pilot projects and housing projects for the People's Armed Forces (including 3 types of projects: public housing projects, social housing projects and commercial housing projects) is both to use national defense land and security land most economically and effectively, in accordance with investment resources and meeting housing needs for the people's armed forces in each period - Mr. Le Hoang Chau emphasized.
