Speaking with Lao Dong, Ms. Doan Thi Thanh My - Deputy Director of the Department of Land Management (Ministry of Agriculture and Environment) said that the Ministry of Agriculture and Environment has assigned the Department of Land Management to develop a separate Decree to handle issues related to the two-level local government model.
In the draft decree, basically, the contents under the responsibility of the People's Council (People's Council) and the district People's Committee (People's Committee) will be decentralized to the commune level. The commune level will continue to perform the current tasks in accordance with the Land Law and detailed guidance decrees. However, for administrative procedures, the Department has reviewed to cut unnecessary steps, in order to reduce the trouble for people and businesses.
Ms. My said that the Decree is built in a shortened procedure, which means it is not necessary to collect opinions. However, land is a very sensitive field, directly affecting people and businesses.
"In the Land Law and Decrees guiding the implementation of this law, there are many contents assigned to the provincial People's Committee for promulgation. With the model of 34 centrally-governed provinces and cities, we see that some localities after the merger may encounter dissonance in policies. Therefore, we have requested localities to urgently review and have transitional regulations to ensure that there are no legal gaps, no barriers and no impact on administrative procedures of people and businesses when implementing the 2-level local government model, especially for the provincial level" - Ms. My said.
Responding to Lao Dong's question about the fact that recently, people in many places complained about the fatigue and time it took to do land procedures, Ms. My said that the drafting agency is proposing that people can choose a place to submit their application regardless of the location where the land is located.
"In this regard, we do not dare to make a final decision because this is only a proposal from the drafting agency. The final decision belongs to the competent authorities. In the area where there is land " - Ms. My said.
According to the Deputy Director of the Department of Land Management, currently, people are also facing many difficulties in submitting land documents, lining up, and if people choose where to submit documents, this situation will be reduced.
In addition, when implementing the commune-level government model, localities will have to develop specific plans to receive documents and handle administrative procedures more conveniently for people and businesses. This will contribute to improving the quality of public administrative services at the commune level, especially when public administrative service centers were previously only concentrated in cities and districts, but will now be expanded at the commune level.
