Pursuant to the provisions of Clause 2, Article 76 of the Housing Law 2023, poor and near-poor households in rural areas are entitled to social housing policies.
Pursuant to Article 29 of Decree 100/2024/ND-CP, housing conditions for enjoying social housing policies are stipulated as follows:
- In case there is no house owned by their ownership when the subject specified in Clause 1, Article 77 of the Housing Law and the spouse of that object (if any) are not named in the land use right certificate, ownership of properties attached to land in the provinces or centrally -run cities where the social housing project is located at the time of submitting the registration dossier for purchase and purchase of social housing.
Within 7 days from the date of receiving the application for certification of the name of the land use right certificate, ownership of properties attached to the land, the office/branch of the district land registration office in the provincial or centrally -run cities where there is a social housing project, the confirmation of the case prescribed in this Clause.
- In case the subject specified in Clause 1, Article 77 of the Housing Law has a house under his/her ownership but the average housing area per capita is less than 15m2 of floor space/person. The average housing area per capita prescribed in this clause is determined on the basis of: the single person, the person's wife (husband), father, mother (if any) and children of that person (if any) registering to reside permanently in that house.
Within 7 days from the date of receipt of the application for confirmation of the average housing area per capita, the People's Committee at the commune level shall confirm the case specified in this clause.
At the same time, based on the provisions of Article 30 of Decree 100/2024/ND-CP, the conditions on income to enjoy social housing policies are stipulated as follows:
- For the subjects specified in Clause 2, Clause 3 and Clause 4, Article 76 of the Housing Law, they must be poor or near-poor households according to the Government's poverty standard.
Thus, poor households in rural areas that are eligible for social housing policies and need to meet additional housing conditions and income conditions as prescribed above can register to buy social housing.
