Pursuant to Clause 2, Article 78 of the 2023 Housing Law, the conditions for enjoying social housing support policies are stipulated:
1. Subjects specified in Clauses 1, 4, 5, 6, 7, 8, 9 and 10, Article 76 of this Law who buy or rent social housing must meet the following conditions:
a) Housing conditions: subjects specified in Clauses 1, 4, 5, 6, 7, 8, 9 and 10, Article 76 of this Law to be able to buy or rent social housing must not have a house of their own in the province or centrally run city where there is a social housing construction investment project, have not been able to buy or rent social housing, and have not enjoyed any form of housing support policies in the province or centrally run city where there is a social housing construction investment project or have a house of their own in the province or centrally run city where there is a social housing project but the average housing area per capita is lower than the minimum housing area; in case of subjects specified in Points b, c, d, e, g and g, Clause 1, 45 of this Law, they must not be in public housing. The Government stipulates in detail this point.
b) Income conditions: subjects specified in Clauses 5, 6, 7 and 8, Article 76 of this Law to be able to buy or rent social housing must meet the income conditions prescribed by the Government; subjects specified in Clause 4, Article 76 of this Law must be poor or near-poor households according to Government regulations.
2. Subjects specified in Clauses 1, 4, 5, 6, 7, 8, 9, 10 and 11, Article 76 of this Law, if renting social housing, do not have to meet the housing and income conditions specified in Clause 1 of this Article.

Compared with the above regulations and the provisions of Article 76 of the 2023 Housing Law, the following subjects are allowed to rent social housing without having to meet the housing and income conditions specified in Clause 1, Article 78 of the 2023 Housing Law:
- People with revolutionary contributions, relatives of martyrs who are eligible for housing improvement support according to the provisions of the Ordinance on Incentives for People with Revolutionary contributions.
- Poor and near-poor households in urban areas.
- Low-income people in urban areas.
- Workers and laborers working at enterprises, cooperatives, and cooperative unions inside and outside industrial parks.
- Officers, professional soldiers, non-commissioned officers of the People's Armed Forces, police workers, civil servants, workers and defense officials serving in the army; people working in secret services, people working in other secret services in secret organizations receiving salaries from the state budget they are working for.
- Cadres, civil servants, and public employees according to the provisions of law on cadres, civil servants, and public employees.
- Subjects who have returned public housing as prescribed in Clause 4, Article 125 of the 2023 Housing Law, except for cases where public housing is revoked due to violation of the provisions of the 2023 Housing Law.
- Households and individuals whose land is recovered and whose houses must be cleared or demolished according to the provisions of law and have not been compensated by the State with houses and residential land.
- Students studying at universities, academies, colleges, vocational schools, and specialized schools as prescribed by law; students studying at public ethnic boarding schools.
