Conditions for being granted a red book according to new regulations
In case of having documents on land use rights (Article 137 of the 2024 Land Law), residential land is granted a red book when meeting the following conditions:
Currently in stable use.
Having documents established before October 15, 1993 on land use rights.
If the document is in the name of another person, there must be a document on transfer of land use rights signed by the parties.
There is no dispute.
Not subject to seizure to enforce the judgment.
In case of no documents on land use rights (Article 138 of the 2024 Land Law), a red book will be considered if:
Households and individuals who are allocated agricultural land under Clause 1, Article 118 and have used non-agricultural residential land/land before July 1, 2014.
Have a permanent residence registration in a locality in a difficult or extremely difficult area. At the same time, the People's Committee of the commune confirmed that the land is not in dispute.
Conclusion: The land use period, whether 10 years or 20 years, is not the basis for granting a red book. The law is based on legal conditions and specific documents of each case.
Procedures for granting red books
Step 1: Prepare documents:
Application for a red book.
Certificate of financial obligations.
Documents for financial obligations exemption/reduction (if any).
Documents on land use rights (if any).
Documents proving ownership of assets attached to land.
Step 2: Submit documents:
Submit to the One-stop Department, the People's Committee of the commune where the land is located or the Land Registration Office.
Step 3: Check and verify:
The People's Committee of the commune checks the current status and disputes.
Specialized agencies for measuring, extracting cadastral records, and comparing records.
The land management agency will: Record/ record maps within 5 days; ask for opinions from the construction agency when there are no documents (responsive within 3 days); check the conditions for granting books, notify financial obligations or reasons for ineligibility; update documents to the land database.
Step 4: fulfill financial obligations:
People pay according to the notice of the tax authority and keep the documents to receive the book.
Step 5: Return the result:
The maximum processing time is 20 days; an additional 10 days for the disadvantaged area, and 3 days for printing and issuing red books (excluding the time to pay financial obligations).
