A resident in Hanoi is concerned that although he has registered for land use rights, because he has not built a house, he is worried that he does not have enough conditions to buy social housing under the support policy.
Regarding this issue, the Ministry of Construction replied that to be able to buy or lease-purchase social housing, people must belong to the group of subjects entitled to policies and meet housing and income conditions according to the provisions of housing law, without stipulating conditions on residential land. This regulation is defined in Article 76 and Article 78 of the 2023 Housing Law.

According to the content amended in Decree No. 54/2026/ND-CP (amending and supplementing Decree No. 100/2024/ND-CP), in case there is no housing owned by them, it is understood that: the applicant (and spouse if any) does not have a name or does not have housing information in the Certificate of land use rights, ownership of assets attached to land in the place where the social housing project is located. Within 7 days from the date of receiving the request for confirmation of housing conditions, the competent authority must confirm according to regulations.
Thus, if people own land but there is no housing on the red book, it is still determined that they do not own housing, and from there, they meet the housing conditions to buy social housing if they still meet other conditions such as income according to legal regulations.
The new regulation does not set the condition that buyers must "not have land" but only requires that they do not have houses owned in the social housing project area, so cases of having land use rights but not building houses are not excluded from this support policy.
Functional agencies recommend that people should proactively contact the Provincial People's Committee and social housing management agencies for detailed guidance when preparing applications to register to buy/rent-purchase social housing in accordance with regulations.
