Citizens should send questions to the Ministry of Agriculture and Environment about the following cases:
The garden land plot was exploited by households since 1990. In 2005, the household arbitrarily built a house on a part of the land. Currently, the household is applying for a first-time Land Use Rights Certificate for both residential land and garden land. Citizen asked: Will the arbitrary construction of a house in 2005 be subject to administrative sanctions before considering the issuance of a Certificate?
Responding to this content, the Ministry of Agriculture and Environment said:
In case before 2005 - the time the household used land to build a house - the land plot has not been identified by the competent authority as agricultural land and is not subject to encroachment or occupation of land, there will be no administrative sanctions when considering granting a Certificate of residential land use rights.
