The Department of Agriculture and Environment of Ho Chi Minh City has just proposed to the Ho Chi Minh City People's Committee to assign the City Land Registration Office to receive and handle the dossier of granting pink books to home buyers at Millennium apartment building, No. 132 Ben Van Don, Khanh Hoi ward after the project was included in the removal of obstacles by Working Group 1645 to consider granting pink books to home buyers.
Previously, in May 2025, the Ho Chi Minh City Court proposed that the City People's Committee cancel measures to prevent transfer transactions at the land plot at 132 Ben Van Don (formerly District 4), which is currently Millennium apartment building.
This petition was stated in the first instance judgment of the Ho Chi Minh City People's Court, related to the case of "violating regulations on management and use of state assets causing loss and waste" of the Southern Food Corporation (Vinafood II).
According to the Ho Chi Minh City People's Court, the trial panel determined that Phu My Hung Investment Joint Stock Company was the third party to receive the transfer of land use rights, was granted a land use right certificate by the competent authority and allowed to implement the project in accordance with regulations.
On this land, Phu My Hung has implemented a project with the commercial name Millennium 132 Ben Van Don, including 2 blocks, 653 apartments, 387 offices for rent, 17 commercial apartments and has sold them all to customers. However, the buyer has not yet been granted a certificate of ownership.
The transfer transactions to home buyers of Phu My Hung are independent civil transactions, not related to the criminal acts of the defendants in the above case. Therefore, the Court recommended that the city cancel measures to prevent transactions at this land, helping to ensure the legitimate rights of investors and home buyers.
Based on the court's proposal, the Department of Agriculture and Environment proposed that the city allow the implementation of the next steps of the certificate issuance dossier and cancel the measure to prevent transactions with the above land.
For the 76 apartments serving resettlement in the project alone, the department proposed that the People's Committee of Khanh Hoi Ward coordinate with the Department of Construction to review the dossier; the consideration of granting pink books will be carried out after completing the procedures according to regulations.
It is known that Millennium Apartment, consisting of two blocks with 653 apartments, 387 offices for rent and 17 commercial apartments, has been sold to customers. The project has been put into use since 2018; by September 2019, the authorities determined that 653 apartments were eligible for pink books.
However, the issuance of the certificate was interrupted due to the land related to the inspection, investigation and trial of the case occurring at Southern Food Corporation (Vinafood II).
Accordingly, in 2005, implementing the Prime Minister's decision on handling and rearranging state-owned houses and land in Ho Chi Minh City, Vinafood II proposed to establish a project to build a commercial center combining office buildings and high-rise apartments on this land.
After that, Mr. Truong Thanh Phong - now General Director of Vinafood II - signed a document to the Ministry of Natural Resources and Environment, requesting the transfer of land use rights at 132 Ben Van Don to the new legal entity, the joint stock company, as the project investor.
On May 15, 2008, the Ho Chi Minh City People's Committee allowed Vinafood II to change the purpose of using the land at 132 Ben Van Don to invest in the construction of high-rise apartments combined with commercial centers and office buildings.
At the end of May 2010, the Department of Natural Resources and Environment of Ho Chi Minh City granted a land use right certificate to Vinafood II. About 2 months later, Truong Thanh Phong, as General Director, signed a document approving the transfer of the right to use the site to Vinh Hoi Company.
From 2009 to 2015, Nguyen Kim Company bought 99.32% of Vinh Hoi Company's charter capital and resold it to Phu My Hung Investment Joint Stock Company. After this deal, Phu My Hung joined hands with Phat Dat Real Estate Joint Stock Company to jointly implement the Millennium project.
The actions of the former leader of Vinafood II caused a loss to the state of more than 113 billion VND. This is the main content in the case that led to the application of transaction prevention measures.
