The Ministry of Agriculture and Environment received a petition from voters in Nghe An province with the content: "Voters reflect obstacles in the implementation of Clause 4, Article 149 of the 2024 Land Law. Currently, the guiding documents for implementing the Land Law have not specifically stipulated the types of documents considered to be "consistent with the provisions of the law on construction" as stipulated in Clause 4, Article 149, causing difficulties for localities in the process of determining dossiers that meet the conditions for issuing Land Use Right Certificates.
It is proposed that the Ministry of Agriculture and Environment soon issue specific guidelines on types of documents in accordance with the provisions of law on construction, as a basis for localities to implement uniformly, conveniently and in accordance with regulations.
Regarding this proposal, the Ministry of Agriculture and Environment has the following opinions:
At point b, clause 2, Section I, Section II.1, point a, clause 9, Section II.2, content B, Part V, Appendix I issued together with Decree No. 151/2025/ND-CP, it has specifically stipulated the components of dossiers submitted when carrying out procedures for initial registration of assets attached to land, registration of changes in cases of registration of ownership of assets attached to land plots that have been granted Certificates, registration of changes in assets attached to land compared to the registered content.
Accordingly, the types of documents submitted include:
- Documents as prescribed in Articles 148, 149 of the Land Law (if any);
- Housing and construction site diagrams (except in cases where the documents specified in Articles 148 and 149 of the Land Law already have diagrams suitable for the current status of houses and construction sites already built);
- Construction design dossiers of works that have been appraised by specialized construction agencies or have a document approving the results of acceptance of completion of construction items, construction works according to the provisions of construction law for cases of certificate of ownership of construction works on agricultural land where the project owner does not have one of the types of documents specified in Article 149 of the Land Law or works are exempt from construction permits according to the provisions of construction law.
Based on the above regulations, for cases where land users have a need to register ownership of assets attached to land, the dossier components submitted to carry out procedures have been specifically guided.
