Hanoi can enforce old apartments if over 75% of homeowners agree

The Resolution recently passed by the National Assembly allows the Hanoi People's Committee to decide on compulsory demolition measures when reaching a consensus rate of over 75% of the homeowner.

On the morning of December 11, with 431/435 delegates in favor, the National Assembly passed a Resolution of the National Assembly to pilot a number of specific mechanisms and policies to implement major and important projects in the capital.

This Resolution takes effect from December 12. 2025 and will be implemented in 5 years.

According to the newly approved resolution, major and important projects in the capital, including public investment projects and PPPs, need to be implemented immediately under the direction of the Politburo, the Secretariat, the Government Party Committee, and the Hanoi Party Committee.

In addition, this group also includes projects that meet important national criteria; projects using local budgets or are on the list of attracting strategic investors with a total investment of VND 30,000 billion or more.

The project to renovate, embellish and reconstruct urban areas is a project to rebuild apartment buildings that must be demolished; a project to renovate, embellish and reconstruct an urban area or many urban areas.

New investment project, renovation of works to handle bottlenecks, urgent problems of traffic congestion, flooding, environmental pollution, urban order.

Regarding the authority to decide and approve investment policies, the City People's Council decides on investment policies for public investment projects and PPP investment projects that do not use central budget capital, including:

Public investment projects, public-private partnership investment projects (PPP investment projects), and investment projects under the provisions of the Investment Law need to be implemented immediately under the direction of the Politburo, the Central Party Secretariat, the Government Party Committee, and the Hanoi City Party Executive Committee.

Public investment projects, PPP projects that meet the criteria of important national projects; public investment projects, PPP projects using local budget capital, other legal capital sources of localities in the city with a total investment scale of VND 30,000 billion or more.

The Resolution also stipulates specific mechanisms and policies on the selection of investors and contractors, policies on planning, architecture, land recovery, land allocation, land lease, mechanisms for capital mobilization to implement projects, measures to ensure urban order, order, social safety and measures to renovate, embellish and rebuild urban areas.

Regarding land recovery, land allocation, land lease, and a resolution to supplement land recovery cases other than those specified in Article 79 of the Land Law, the City People's Council decides on the list of land recovery projects to implement socio-economic development projects for national and public interests.

Notably, for projects that need to be implemented immediately under the direction of the Politburo, the Secretariat, the Government Party Committee, and the Hanoi Party Committee, the draft clearly states that the City People's Council decides on the compensation, support, and resettlement level twice as prescribed.

Regarding measures to renovate, embellish and rebuild urban areas, the resolution allows the Hanoi People's Committee to decide on measures to enforce demolition when reaching a consensus rate of over 75% of homeowners and landowners equivalent to at least 75% of the land area in the renovation area.
