Hanoi City People's Committee requests communes and wards to mobilize people to consolidate land plots and construction blocks, and at the same time strictly control construction order, in order to limit the emergence of "super-thin, super-skewed" houses after implementing traffic projects and urban embellishment.
While waiting for the completion of regulations on handling land plots that do not meet the conditions for existence after recovery, the Hanoi Department of Agriculture and Environment requests localities to proactively mobilize people to consolidate land plots with adjacent land plots or consolidate adjacent housing projects.
According to the Department of Agriculture and Environment, the process of land recovery to implement traffic projects and socio-economic development may give rise to remaining land plots with small areas, inappropriate shapes or not meeting construction conditions.
The handling of these land plots must first be based on Clause 7, Article 91 of the 2024 Land Law. According to regulations, when the State recovers land according to Article 78 and Article 79, if the remaining area of the land plot is smaller than the minimum area prescribed by the Provincial People's Committee and the land user agrees to recover, the competent People's Committee will decide to recover, implement compensation, support and manage this area according to regulations.
In case people do not agree to recover, the remaining area is managed and used according to the provisions of the law on land, construction and related regulations.
The possibility of construction on these land plots is considered according to the Hanoi City Architecture Management Regulations issued together with Decision No. 73/2024/QD-UBND dated December 31, 2024.
According to regulations, construction works should not be built on land plots with a remaining area after site clearance of less than 15m2 and adjacent to roads and streets. However, in some special cases, in order to continuously complete the street and ensure urban landscape, construction works may be considered for construction permits.
Specifically, land plots under 15m2 must have edges of 3m or more, meeting the conditions for arranging stairs, living rooms and auxiliary areas according to current standards; only one frontage and located between two adjacent houses meeting construction conditions.
The project being considered must have a floor height, height and facade architecture consistent with at least one adjacent house in a combined direction, not creating sides, vertical faces facing the outside or exceeding the height of the adjacent house.
For land plots with an area larger than 15m2 but one side smaller than 3m, regulations allow the construction of one-story buildings, with a height of less than 4.5m.
Hanoi City People's Committee also encourages land plot consolidation or consolidation of adjacent houses in existing residential areas. The land plot after land plot consolidation must have an area of 15m2 or more, the frontage width and depth compared to the construction boundary must be 3m or more.
According to Conclusion Notice No. 723 dated August 8 of the Hanoi City People's Committee Office, the city assigned the Department of Justice to review regulations related to handling cases that do not meet the conditions to exist after the State recovers land.
Based on the Capital Law No. 02/2026/QH16, the Department of Justice is assigned to advise and propose to the Hanoi People's Committee to issue regulations on handling cases arising when land is recovered to implement socio-economic development projects for national, public interests or for national defense and security purposes.
While waiting for new regulations, the Department of Agriculture and Environment requests the People's Committees of communes and wards to strengthen propaganda and mobilize people to combine plots and blocks; and at the same time inspect and strictly manage construction order, not allowing small, narrow land plots to become points of "super-thin, super-skewed" houses, affecting the landscape and urban order.
The recovery, consolidation, consolidation, or consideration of construction must be carried out in each specific case, ensuring compliance with legal regulations, harmonizing the rights of land users with the requirements of urban embellishment and development of Hanoi Capital.
