According to the urgent announcement No. 81/TB-UBND of the People's Committee of Hai Phong City, the city reclaims the land in An Dong Ward, An Duong District with an area of 10,302.7m2 managed and used by Mai Thanh An Company Limited in the case of land recovery due to violation of land laws as prescribed in Clause 8, Article 81 of the 2024 Land Law (formerly Point i, Clause 1, Article 64 of the 2013 Land Law).
The location and boundaries of the land are determined according to the main continental Tracts: No. 375/2022-TL dated July 20, 2022; No. 399/2022-TL dated August 17, 2022 established by the Center for Engineering - Data, Natural Resources and Environment Information under the Department of Natural Resources and Environment. Mai Thanh An Company Limited is not compensated for land, assets attached to the land and remaining investment costs in the land.
The city requires Mai Thanh An Company Limited to urgently relocate assets on the land in An Dong ward, An Duong district within 45 days from March 19, 2025. After the above deadline, the assets that have not been relocated from the land are determined to no longer need to be used, the City People's Committee will continue to carry out the procedures for land recovery due to violations of land law according to regulations and will not be responsible for the assets that have not been relocated from the above land.
In case Mai Thanh An Company Limited does not comply, Hai Phong City People's Committee assigned An Duong District People's Committee to enforce the decision to reclaim the land according to regulations.
Previously, the People's Committee of Hai Phong City issued Decision 457/QD-UBND dated April 11, 2012, Decision No. 26/QD-UBND dated January 4, 2013 on allowing Mai Thanh An Company Limited to lease land in An Dong commune (now An Dong ward) to implement an investment project to build, manage, operate and exploit the new An Dong market. By October 17, 2022, the City People's Committee will continue to extend the land use term for 24 months for this enterprise to implement the above project.
