Detailed instructions on procedures for correcting red books from 1.7.2025

Procedures for correcting red books after removal from district level are guided in Part V of Appendix I issued with Decree 151/2025/ND-CP (officially applied from July 1, 2025).

- Accordingly, if the competent authority or person discovers that the issued Certificate has errors, they shall notify the Certificate recipient and request to return the original Certificate issued for correction;

- In case the person granted the Certificate discovers that the Certificate issued for the first time has errors, the application must be submitted to the One-stop Department, the application includes:

+ Application for registration of changes in land and assets attached to land according to Form No. 18.

+ Original Certificate of Land Use Rights;

+ Documents proving that the information of the person granted the Certificate is incorrect compared to the information at the time of request for correction or that the information about the land plot or property attached to the land is incorrect compared to the information on the issued Certificate;

+ In case the land user or owner of the property attached to the land discovers it, collects the content specified in the Point according to the provisions of the law on civil matters, there must be confirmation from the relevant agency or organization.

The dossier receiving agency shall:

+ Check the completeness of the dossier and issue a dossier receipt and schedule a return of results.

+ In case the documents are not complete, the documents must be returned with the Supplement and Complete Application Form so that the applicant can register to complete and supplement according to regulations.

+ Transfer the dossier to the competent land management agency;

- In case the person granted the Certificate discovers that the issued Certificate when carrying out the procedures for registering changes in land and assets attached to land has errors, the dossier must be submitted to the One-stop Department of the Land Registration Office or Branch of the Land Registration Office, the dossier includes:

+ Application for registration of changes in land and assets attached to land according to Form No. 18.

+ Original Certificate of Land Use Rights;

+ Documents proving that the information of the person granted the Certificate is incorrect compared to the information at the time of request for correction or that the information about the land plot or property attached to the land is incorrect compared to the information on the issued Certificate;

+ In case the land user or owner of the property attached to the land discovers it, collects the content specified in the Point according to the provisions of the law on civil matters, there must be confirmation from the relevant agency or organization.

The dossier receiving agency shall:

- Check the complete components of the documents and issue a dossier receipt and schedule a return of results.

- In case the dossier components are not complete, the dossier must be returned with the Supplement and Complete dossier Request Form so that the dossier requester can complete and supplement according to regulations.

- In case the dossier receiving agency is the One-stop Department, the dossier shall be transferred to the Land Registration Office.

In case the first-issued Certificate has errors, the competent authority shall:

- Notify the Land Registration Office to transfer the dossier for granting the Certificate to the competent authority issuing the Certificate;

- Check the dossier, make a record of the conclusion on the content and cause of errors;

- Submit to the competent authority or person issuing the Certificate prescribed in Article 105 of the 2024 Land Law to decide on the correction on the issued Certificate or the newly issued Certificate of land use rights and ownership of assets attached to land;

- Transfer the dossier to the Land Registration Office to update and edit the cadastral records and land database; grant a Certificate of land use rights and ownership of assets attached to the land or send it to the dossier receiving agency to give to the granted person.

In case the Certificate issued when carrying out the procedures for registering changes in land and assets attached to land has errors, the Land Registration Office shall:

- Check and make a record of the conclusion on the content and cause of errors;

- Confirm the correction on the issued Certificate or newly issued Certificate of Land Use Rights and Property Ownership Rights attached to the land;

- Adjust and update changes in cadastral records and land databases; grant a Certificate of land use rights and ownership of assets attached to land or send it to the dossier receiving agency to give to the granted person.
