Previously, through the Trang to receive recommendations and feedback from Khanh Hoa province, a citizen in Bao An ward sent a question with the above content.
This person's family has a piece of land in the countryside (belonging to plot number 1260, map sheet number 09, area of 108m2, of which 99m2 is rural land and 9m2 is rice land in the traffic boundary planning) on the frontage of Yen The road, Bao An ward (formerly Thanh Hai commune, old Ninh Thuan province).
The family wants to build a level IV house with an area of 25m2 as a place to live.
However, citizens are wondering whether this project will need a construction permit or not, because the area was previously part of a new rural commune.
If so, which authority has the authority to grant the license, what are the procedures and how long does it take to resolve?
In the petition, the citizen also cited Clause 2, Article 89 of the 2014 Construction Law, which stipulates cases exempted from construction permits, including Point i: "Grade IV construction works, individual houses in rural areas with a scale of less than 7 floors and located in areas without urban planning...".
Regarding this content, the Department of Economic Infrastructure and Urban Areas of Bao An Ward cited Article 107 of the 2014 Construction Law (amended and supplemented in Clause 39, Article 1 of the 2020 amended Construction Law), stipulating the conditions for starting construction "A construction permit for a construction work must have a construction permit according to the provisions of Article 89 of this Law".
Therefore, the specialized agency recommends that citizens contact the Bao An Ward Public Administration Service Center for guidance and to carry out construction permit application procedures according to current regulations.
