Solutions when land plots have incorrect coordinates and overlapping boundaries in Phu An ward

Ho Chi Minh City - Regarding the case of a man suspected of committing suicide after buying land overlapping the boundary, Phu An Ward People's Committee responded to the situation of land being ordered to have coordinates and overlapping the boundary.

Phu An Ward People's Committee (HCMC) confirmed that there is a situation where some land plots have differences in coordinates or overlapping boundaries when comparing between dossiers, maps and the current land use status.

Phu An Ward People's Committee said that the main reason is that in the past, the old map system was used, measuring through many periods, at times performed manually, so the data was not completely synchronized with the VN-2000 national coordinate system.

When a land plot is found to show signs of offset or overlapping boundaries, people should contact the local land management functional agency for guidance. Based on information about the land plot and land area being reflected, the Ward People's Committee will coordinate with Branch of Land Registration Office No. 23, Neighborhood Management Board and related units to check dossiers, compare issued certificates, cadastral maps, and current land use status. At the same time, units organize measurement and relocation of the current status according to the national standard coordinate system and verify opinions of adjacent households.

In case of deviations due to measuring techniques that do not change the actual land use boundaries, the Ward People's Committee shall coordinate with the land registration agency to review and request adjustment of coordinates on the map and correct the issued certificate to be appropriate;

In case of deviations leading to disputes or determining that there is overlapping boundaries in reality, the Ward People's Committee organizes mediation between the parties according to regulations. If mediation fails, people file a lawsuit in court to be considered and delimited according to the law.

Regarding the case of Mr. H.B.L suspected of committing suicide after buying land with overlapping boundaries in Phu An ward, Phu An Ward People's Committee said: through the review results of the Economic, Infrastructure and Urban Department of the ward, no deviation of coordinates as some information spread was recorded. In fact, the land plot related to Mr. H.B.L and adjacent households is somewhat overlapping. However, from the time the parties had transactions to date, Phu An Ward People's Committee has not received any applications from related parties requesting land boundary determination or resolving boundary disputes.

Previously, Lao Dong Newspaper reported on the case, on July 25, Mr. H.B.L (37 years old, from Nghe An) suspected suicide after buying land overlapping the boundary in Phu An ward. After the incident, functional agencies intervened to verify and clarify. Currently, Mr. H.B.L's family has completed procedures to transfer the land plot to the seller and received the money back.
