Areas permitted by Hanoi to build works on agricultural land

Hanoi officially allows the construction of temporary works serving production and tourism in agricultural areas on riverbanks and floating areas on riverbanks with dykes.

On July 9, with 100% of delegates present in agreement, the 16th Hanoi People's Council passed a Resolution regulating the form of use and exploitation of agricultural land in riverbanks and floating flats on rivers with dykes in the city.

The Resolution is based on Point a, Clause 3, Article 32 of the Capital Law, aiming to develop agriculture, ecological agriculture and combine tourism, education and experience, at the same time, ensure dyke safety, prevent and combat natural disasters and protect the environment.

Accordingly, for agricultural production on riverbanks and floating areas on riverbanks with dykes, people are allowed to use part of the area to build works serving agricultural production.

The condition for using a part of the land area to build and install works directly serving agricultural production is that the land must have an area of 1,000m2 or more.

The construction and installation location of the project is outside the dike protection area, not in the landslide area or at risk of landslides, not often affected by flooding and inundation. People pledged not to level or dismantle the construction themselves and not to be compensated when the state agency reclaims or implements the projects.

The maximum construction area is 10m2 (for land with a scale of 1,000m2 to 5,000m2) and a maximum of 20m2 (for land with a width of over 10,000m2).

Constructions directly serving agricultural production can only be built with 1 floor, no more than 4m high and no basement.

Organizations and individuals using agricultural land at riverbanks and floating areas for agricultural production combined with tourism and experiential education are allowed to use a part of the land area to build service works.

The condition is that the total land area of 10,000m2 or more, with a plan for using land combined with multiple purposes for agricultural production combined with tourism, education and experience has been accepted.

The construction and installation location of the project is outside the dike protection area, not in the landslide area or at risk of landslides and is in accordance with the regulations on the use of riverbanks according to the flood prevention and control plan.

People pledged not to level or raise existing riverbanks, and not to receive compensation when the existing period expires or the state agency reclaims to implement the projects.

The total construction area of the works does not exceed 5% of the land area outside the flood drainage corridor for the Day River system, or in the riverbank area studied for construction for the Red River and Thai Binh River systems.

The structure of the project is semi-solid, using environmentally friendly materials, easy to dismantle. The project is built with 1 floor, no more than 6m high and no basement.
