The Ministry of Agriculture and Environment is assigned to coordinate with the Ministry of Construction to respond to the recommendations of voters in Bac Ninh province with the content: "Requesting the Government to study and submit to the National Assembly for consideration of amending and supplementing the 2024 Land Law; Construction Law; Public Investment Law in 2019; Housing Law 2023 in the direction of: For mountainous areas with difficult economic conditions such as Son Dong commune, Bac Ninh province, allowing the use of public investment capital to invest in housing projects, residential areas or having special mechanisms (not calling on investors to use capital outside the budget) then subdividing plots, organizing auctions of land use rights for individuals; not applying conditions for building rough houses or designing model houses because they are not suitable for the cultural reality of the region, on the other hand, people cannot afford to buy land and rough houses".
Regarding this proposal, the Ministry of Agriculture and Environment reports to the National Assembly Delegation, the Government Office and voters of Bac Ninh province as follows:
The content of voters' petitions relates to amending legal regulations on public investment capital sources and the application of conditions for building rough houses or designing house models under the functions and tasks of the Ministry of Construction. The Ministry of Agriculture and Environment will closely coordinate in the process of reviewing and perfecting policies and laws.
Regarding the content of voters' petitions mentioned above, the land law stipulates:
- According to the provisions of Clause 27, Article 79 of the Land Law, the State recovers land for the following cases: "27. Implementing investment projects to build urban areas with mixed and synchronous functions of technical infrastructure and social infrastructure with housing according to the provisions of law on construction for new construction or renovation and embellishment of urban areas; rural residential area projects";
- According to the provisions of point b, clause 1, Article 125 of the Land Law, the State allocates land with land use fees, leases land for one-time payment for the entire lease term through auction of land use rights for the following cases: "b) Allocating residential land to individuals except for cases specified in Article 124 of this Law".
