On the Ministry of Construction's Information Portal on November 10, citizen D.H reported that in 2023, I submitted an application to buy a social housing and had met the conditions for signing a lease-purchase contract (signed in December 2023), but this year the investor called to report the approval to make a pink book, but I was not eligible because my income exceeded 15 million VND/month. So I would like to ask which year the home buyer registered to be approved?
After studying, the Department of Housing and Real Estate Market Management (Ministry of Construction) said that due to incomplete citizen feedback, the Ministry of Construction responded on the principle as follows:
Cases of signing social housing purchase and rental contracts in 2023 will apply the 2015 Housing Law and guiding documents for implementation.
Buyers and tenants of social housing must comply with regulations on subjects, income conditions, housing conditions, etc. when submitting documents to buy social housing according to the 2015 Housing Law and guiding documents for implementation.
Accordingly, Point c, Clause 1, Article 51 of the 2015 Housing Law stipulates:
Conditions for enjoying social housing support policies.
For the cases specified in Clause 1, Article 50 of this Law, the following conditions on housing, residence, and income must be met:
For subjects specified in Clauses 4, 5, 6 and 7, Article 49 of this Law, they must not be subject to regular income tax payment according to the provisions of the law on personal income tax.
Clauses 2 and 6, Article 62 of the 2015 Housing Law stipulates:
Principles of leasing, leasing, buying and selling social housing
The minimum term of a social housing rental contract is 05 years; the minimum term of payment for social housing rental is 05 years, from the date of signing the housing rental contract.
In all cases of leasing, leasing, and selling social housing that are not in accordance with the provisions of this Law, the lease, lease, and sale contract of housing that is not legally valid and the lessee, lessee, or buyer must hand over the house to the social housing management unit; in case the house is not handed over, the People's Committee at the provincial level where the house is located will organize enforcement to recover the house.
The Department of Housing and Real Estate Market Management recommends that citizens study the provisions of the law on social housing mentioned above to implement.
