Restoring order in land management and use
Implementing the plan to handle land violations, the authorities of many localities in Hanoi organized enforcement and demolition of a series of illegal construction works on agricultural land and public land, in order to restore order in land management and use.
According to the plan of the People's Committee of Hat Mon commune, from December 23, the Commune Enforcement Board will organize the enforcement of remedial measures for 5 cases of violations in the land sector.
The violations are located in Dong Mieu, Doc Cai, Bai Gia areas in Tao 1, Tao 2, Tao 3 villages, related to 5 plots of land illegally used by Mr. Tran Hoc Thai, Ho Huu Duc, Phan Dinh Thanh, Do Duy Thang and Phan Dinh Kham households to build works on agricultural land.
At the same time, the People's Committee of Thanh Oai commune also issued a notice to organize enforcement and demolition of many illegal construction works on public land and agricultural land in areas of the old communes of Phuong Trung and Thanh Mai.
According to the published list, there were 10 violations with a total area of thousands of square meters. The main violations are erecting iron frames, roofing with corrugated iron, building level 4 houses, pouring concrete for the foundation or leveling the ground on agricultural land and beach land. In particular, there was a case of leveling the land with a volume of more than 340m3, deforming the current status of the land.

Thanh Oai Commune People's Committee requested violating households to voluntarily dismantle all works and restore the land to its original state. In case of non-compliance, the local government will organize enforcement according to the provisions of law.
The simultaneous organization of enforcement in many areas shows the determination of the grassroots government in tightening land management discipline, preventing prolonged illegal construction, causing public outrage and potentially violating land use planning.
Need to be strictly handled
Talking to Lao Dong reporter, Mr. Truong Anh Tu - Chairman of TAT Law Firm said that after the 2024 Land Law took effect, in many localities, a wave of large-scale agricultural land buying up appeared.
Worryingly, there are many cases of buying land not for production or farming purposes but to build factories, houses, homestays or wait for prices to increase, benefiting from compensation policies when the State reclaims land.
According to lawyer Tu, the consequence is that many agricultural land areas are used for the wrong purpose, causing waste of land resources and negative consequences. This situation not only directly affects agricultural production and food security, but also makes it difficult for businesses and farmers to effectively access land funds for production.
To prevent the above situation, lawyer Truong Anh Tu said that it is necessary to tighten land use conditions after receiving the transfer of rights, in which it is mandatory for land users to put the land into production and cultivation for the right purpose. In case the requirements are not met, the State agency can reclaim the land according to regulations.
In addition, authorities need to strengthen inspection, examination, and supervision of land use, strictly handle acts of improper use or land abandonment.
The disclosure and transparency of information on land use planning is also identified as an important solution to limit the situation of taking advantage of planning to speculate and manipulate land prices.
"If the land is not used for the right purpose, the State has the right to reclaim it. In serious cases, causing planning disruption or great damage to the State and society, criminal liability can be completely considered. This is a necessary mechanism to protect land resources and ensure that land accumulation policies are not abused," emphasized lawyer Tu.
