Penalties for arbitrarily converting rice-growing land to other types of land in Hanoi

When arbitrarily converting rice-growing land to other types of land in the agricultural land group, people may be fined at different levels.

Pursuant to Clause 1, Article 8 of Decree 123/2024/ND-CP, it is stipulated as follows:

Article 8. Using rice-growing land to other types of land without permission from a competent State agency

1. The form and level of penalty for converting rice-growing land to other types of land in the agricultural land group is as follows:

a) Fine from VND 2,000,000 to VND 3,000,000 for land area under 0.5 hectares;

b) Fine from VND 3,000,000 to VND 5,000,000 for land area from 0.5 hectares to less than 01 hectare;

c) Fine from VND 5,000,000 to VND 10,000,000 for land area from 01 hectare to less than 03 hectare;

d) Fine from VND 10,000,000 to VND 30,000,000 for land area from 03 hectares or more.

Accordingly, arbitrarily converting rice-growing land to other types of land in the agricultural land group without permission from a competent State agency is an act that will be subject to administrative sanctions as above.

In addition, according to Clause 1, Article 3 of Resolution 09/2025/NQ-HDND of the Hanoi People's Council, it is stipulated as follows:

Article 3. Fine level

1. The fine for administrative violations prescribed in this Resolution is 02 (twice) times the fine for corresponding administrative violations prescribed in Decree No. 123/2024/ND-CP in Hanoi, but not exceeding the fine prescribed in Article 24 of the Law on Handling of Administrative Violations.

2. The fine for violations specified in Clause 1 of this Article is the fine applied to individuals (except for violations by organizations specified in Clauses 4, 5, 6, Article 18, Clause 1, Article 19, Point b, Clause 1 and Clause 4, Article 20, Article 22, Clause 2 and Clause 3, Article 29 of Decree No. 123/2024/ND-CP). For organizations with the same violation, the fine is 02 (twice) times the fine for individuals.

At the same time, based on Point c, Clause 3, Article 1 of the 2025 amended Law on Handling of Administrative Violations, the maximum fine in the land sector for individuals is VND 500 million and for organizations is VND 1 billion.

Thus, the penalty for arbitrarily converting rice-growing land to other types of land in the agricultural land group in Hanoi is specifically as follows:

- Fine from VND 4,000,000 to VND 6,000,000 for land area under 0.5 hectares;

- Fine from VND 6,000,000 to VND 10,000,000 for land area from 0.5 hectares to less than 01 hectare;

- Fine from VND 10,000,000 to VND 20,000,000 for land area from 01 hectare to less than 03 hectare;

- Fine from VND 20,000,000 to VND 60,000,000 for land area from 03 hectares or more.

Note, above is the fine for individuals, for organizations with the same violation, the fine is 02 (twice) times the fine for individuals.
