Land allocation adjustment procedures not completed
At the end of October, in an interview with Lao Dong Newspaper reporters regarding the issuance of land use right certificates (red books) for 72 townhouses in the Sunny Garden City project (Quoc Oai, Hanoi), CEO Group said there were some problems.
According to the company, in July 2023, the Hanoi Department of Natural Resources and Environment sent a delegation to inspect the project and legal documents, assessing that the project needed to supplement land allocation adjustment procedures due to differences in project area in the Land Allocation Decision and in the latest adjusted planning of the project.
"According to Decision No. 298/QD-UBND dated February 4, 2008 of the People's Committee of Ha Tay province (now Hanoi city), the Company was assigned a land area of 244,174.5 square meters for the project.
According to Decision No. 1782/QD-UBND dated May 4, 2020 of Hanoi People's Committee on planning adjustment, the project area is 238,229m2.
Reason for the area being reduced compared to the original planning: The city's implementation of the North-South urban axis road in Quoc Oai district overlaps part of the project's land area, so the scale of the project is reduced by 5,945.5 square meters.
The additional procedures for adjusting land allocation due to the state adjusting the project planning have led to the procedure for granting Certificates to customers buying adjacent houses being longer than expected," said CEO Group.
Along with this content, CEO Group sent along relevant documents. However, the latest document provided to Lao Dong reporter is the "Receipt of application and appointment to return results" from the Hanoi Department of Natural Resources and Environment dated March 4, 2024.
In mid-November 2024, CEO Group said that regarding the land allocation adjustment procedure, the Hanoi Department of Natural Resources and Environment is currently conducting a second consultation, and the Department of Construction and the Department of Planning and Architecture have sent written comments to the Department of Natural Resources and Environment.
"The Department of Natural Resources and Environment has consulted with departments and agencies. During this process, the Company regularly contacts state agencies to coordinate in providing documents when requested and to grasp the implementation progress. The opinions of departments and agencies are sent to the Department of Natural Resources and Environment, not to the Company" - said the CEO Group.
Regarding the company's settlement roadmap and the expected time limit for issuing red books to residents, CEO Group said: The company has been and will continue to grasp relevant information and coordinate to resolve arising issues (if any) so that the Department of Natural Resources and Environment can soon submit to the City for land allocation adjustment.
"After the City has decided to adjust the land allocation, the Company will speed up the general legal appraisal procedure of the project (step 1 in the process of granting the Certificate) and submit the application for granting the Certificate to the customer (step 2)" - CEO Group provided information.
Admit slow progress
Meanwhile, in the latest document sent to customers at the end of October regarding the application for red books for the townhouses of the Sunny Garden City project, CEO Group admitted that "the process of implementing related procedures is currently slower than the expected progress discussed".
This document does not give a specific time limit by which the procedures can be completed.
At the end of October, Lao Dong reporters asked the Hanoi Department of Natural Resources and Environment: "Has the unit received a proposal and completed procedures to grant land use right certificates for townhouses in the Sunny Garden City Urban Area (Quoc Oai, Hanoi) from CEO Group? If so, please let us know the results of the settlement up to now.
Are there any problems or difficulties in the process of granting land use right certificates in the above cases?
However, as of November 27, the Hanoi Department of Natural Resources and Environment has not responded to the above content.
Lao Dong Newspaper published an article reflecting on the CEO Group's continuous "missed appointments" to issue red books for townhouses in the Sunny Garden City urban area (Quoc Oai, Hanoi).
According to Lao Dong reporter's investigation, the contract for buying and selling the townhouse here states: "The procedures, documents and time for granting the Certificate to the Buyer are under the decision of the competent state agency".
But the strange thing is that for many years from 2021 to now, CEO Group has continuously set deadlines for completing the issuance of red books and then missed them. This has caused a lot of frustration for residents.
