Speaking with Lao Dong, lawyer Nguyen Thi Hau - Lawkey Law Firm - said that, based on Decree 151/2025/ND-CP on the division of land management authority between two levels of local government, from this time, the People's Committees at the commune level and the Chairman of the People's Committees at the commune level will be assigned to perform many tasks and powers in the land sector. This is an important reform step, aiming to create maximum convenience for people and businesses when implementing procedures related to land.
Some contents include: Approving plans for the use of agricultural land and rice fields; deciding to reclaim land in specific cases according to the provisions of law; issuing land recovery notices and approving compensation, support and resettlement plans; granting Certificates of land use rights and ownership of assets attached to land; re-determining residential land areas; deciding to allocate land, lease land, change land use purposes... will be decentralized to the commune level.
Mr. Mai Van Phan - Deputy Director of the Department of Land Management, Ministry of Agriculture and Environment - said that to shorten the implementation process, Decree 151 has adjusted decentralization in the procedures. A typical example is the issuance of the first Land Use Rights Certificate to households and individuals assigned to the commune level.
According to Mr. Phan, the document components have also been streamlined. According to the new regulation, when authority is assigned to the commune level, there is no need to establish a council, nor is it necessary to arrange time for that process. This not only helps shorten the settlement time but also strengthens the role and responsibility of the Chairman of the Commune People's Committee in land management in the locality.
Current regulations, the procedure for granting a Certificate is carried out after the land user submits a registration application and fulfills financial obligations. Land users submit a dossier to request a Certificate and perform financial obligations to the tax authority - this period is valid for 17 days. After completing financial obligations, the dossier is transferred to the competent authority for settlement and the Chairman of the People's Committee at the commune level signs to issue the Certificate within 3 working days.
Mr. Phan assessed that this is a correct policy of the Party and State and a revolutionary reform step in the land management sector, demonstrating the principle of "close to the people, serve the people".
In an interview with Lao Dong, Dr. Tran Xuan Luong - Deputy Director of the Vietnam Institute for Real Estate Market Research and Evaluation - said that in order for the two-level government model to operate effectively, it is necessary to strengthen supervision and ensure transparency in the operations of commune-level government. He proposed promoting the digitalization of the process of processing documents to make monitoring and inspection more convenient and strict. This will help limit errors in land management, minimizing the impact on people.
Dr. Luong also emphasized the role of post-inspection work. In case errors are discovered after the licensing, the competent authority needs to revoke the relevant documents and strictly handle the responsibility of the head.
The Ministry of Agriculture and Environment has just issued Decision 2304/QD-BNNMT announcing administrative procedures in the field of land under the State management functions of the ministry. A series of procedures related to land change registration are carried out at the provincial level such as: Individuals using land to establish private enterprises; transfer, inherit, contribute capital, lease or handle assets attached to land in civil and commercial transactions; change land user information; change land use purposes without permission; handle the results of judgments, enforcement decisions or land disputes.
