Over the years, the situation of people arbitrarily changing the purpose of use, building houses and works on contracted agricultural and forestry land has become popular, causing great difficulties for local authorities in controlling, reclaiming and issuing land use right certificates.
In the case of Ms. N.T.G (in Hat Lot commune, Mai Son district) being allocated 5,000m2 of protective forest land, her family arbitrarily built a solid house on the forest land but has not yet been completely handled.
Similarly, in Moc Chau district, Mr. L.V.Y's family was also allocated 18,320m2 of land from Co Do Farm, although the land use purpose has not been changed. However, his family arbitrarily built a camp and ancillary structures, violating land laws.
Violations of land laws not only occur in mountainous districts of Son La province but also in Son La city, this situation is very common. Within less than 10 days, the People's Committee of Son La city had to carry out enforcement against a series of households encroaching on land and illegally constructing.
According to the reporter of Lao Dong Newspaper, on June 11, the People's Committee of Son La city had to enforce land recovery for Mr. Nguyen Duc Hop's household (Group 3, Chieng Coi ward). Mr. Hop's family arbitrarily encroached on 259.6m2 of land managed by the State to build a house. The local government has repeatedly mobilized and dialogueed, but this household has not cooperated.
Most recently, yesterday (February 18), also in Chieng Coi ward, the People's Committee of Son La city continued to enforce and reclaim land from the household of Ms. Hoang Thi Yen and Ms. Cam Thi Ngoc Thien. These are 2 households, receiving illegal land transfers, illegally constructing on the land.
Despite being discussed, propagated and mobilized by local authorities many times, these households have not complied with the demolition and relocation of assets, affecting the progress of site clearance for project implementation.
Through the review of the functional sectors of Son La province, it was noted that hundreds of households used land for the wrong purpose, many cases of unofficial "buy-sell" and illegal construction on land that had not been granted a certificate.
The cause of the above problems stems from the history of land allocation not being clear to farms and forestry farms, not measuring and marking accurately. There are even areas that surround residential areas on agricultural land.
In addition, after equitization, many enterprises do not have a land use plan and cannot control the allocated land fund, leading to prolonged encroachment and misuse.
Along with that, the legal system and guiding documents on land are constantly changing, causing confusion and inconsistency in handling. Detailed measurement work has not been fully implemented due to lack of funding. The land returned to the locality is mainly pre-arranged, and each type of land, purpose of use, and user has not been determined.
Faced with the above situation, on June 17, the People's Committee of Son La province issued a document directing relevant units to strengthen management and prevention of law violations in the land sector in the province.
Accordingly, the People's Committee of Son La province requests the Chairmen of the People's Committees of districts, towns and cities, Chairmen of the People's Committees of communes, wards and towns to strictly fulfill their responsibilities in detecting, preventing and handling violations of the law on land management and use according to regulations.
At the same time, strengthen inspection, detection and handling of illegal construction works and projects on agricultural land, land originating from agricultural and forestry farms, etc. When discovering signs of a crime, the document was transferred to the provincial police investigation agency for settlement according to regulations.
