On the morning of December 8, the National Assembly discussed in the hall the Draft Resolution of the National Assembly on specific mechanisms and policies to implement major projects in the capital.
At the end of the discussion session, Minister of Finance Nguyen Van Thang explained and accepted the opinions of National Assembly deputies.
According to the Minister, the Draft Resolution of the National Assembly on specific mechanisms and policies to implement large projects in the capital focuses on removing and simplifying procedures for 5 groups of large and important projects:
Public investment projects, PPP projects, and private investment projects need to be implemented immediately according to the direction of competent authorities;
Public investment projects, PPP projects that meet national key project criteria, using local budgets, with a total investment of VND 30,000 billion or more;
Projects on the list of attracting strategic investors with an investment scale of VND 30,000 billion or more;
Projects to renovate, embellish and reconstruct urban areas such as rebuilding apartment buildings; renovating, embellishing and reconstructing one or more urban quarters;
New investment projects and renovation projects aim to handle urgent bottlenecks of traffic congestion, flooding, environmental pollution and urban order.
Regarding land recovery to implement projects in Hanoi, Minister Nguyen Van Thang stated that in reality, large and important projects in Hanoi often have very diverse land use purposes, including sports land, culture, trade, services, ... and there are projects that are not subject to land recovery according to the provisions of Article 79 of the Land Law or Resolutions to remove current obstacles. The application of the listed methods in current law does not ensure completeness and may miss breakthrough projects of international, national or regional scale in the future.
Therefore, the Government proposes that the National Assembly issue a resolution, assigning authority to the City People's Council to decide on each specific case of land recovery to implement a specific project, ensuring proactiveness but still strict control. The Government has considered the option of assigning the People's Council to issue a list of projects, but this option is difficult to ensure controlling each project, so the Government proposes to assign the People's Council to decide on each specific case.
To ensure publicity and transparency, the draft Resolution stipulates a compensation level higher than current regulations to create consensus and ensure social security. This policy creates conditions for Hanoi to proactively exploit land resources, increase competitiveness, attract investment and create momentum for socio-economic development.
Many delegates raised the issue of whether this policy is superior to the current authority of the locality or not. Regarding this issue, the Minister affirmed the general spirit of "The mechanism must be breakthrough, superior for Hanoi but still ensures feasibility" and raised the issue that if the compensation level of a project is too high compared to an adjacent project, it will cause comparison among the people. This is an issue that many localities are facing and Hanoi needs to pay special attention to during the implementation process.
In addition, the draft also allows Hanoi to decide on enforcement measures in cases where at least 75% of homeowners and land owners, equivalent to 75% of the area of the renovation, renovation and reconstruction area, agree.
According to the Minister, this measure is necessary to ensure the safety of people's lives and speed up the project's progress. The measure only applies to old, dangerous apartment buildings, with over 75% of residents in agreement and after fully implementing the steps of compensation, support, resettlement and propaganda and mobilization. The enforcement is carried out in accordance with legal regulations, including preparing a resettlement plan, publicly posting, issuing decisions according to regulations, etc.
We expect this policy to create more tools for Hanoi to accelerate urban beautification work, said the Minister.
