Pursuant to Article 240 of the 2024 Land Law, the handling of people who violate the law in land management when performing official duties is as follows:
1. People who violate the law in land management while performing official duties will be subject to disciplinary action or criminal prosecution according to the provisions of law for the following violations, depending on the nature and severity of the violation:
a) Taking advantage of or abusing positions and powers to contrary to the provisions of law in planning, land use plan, land allocation, land lease, land use purpose, land recovery, land use, compensation, support, resettlement, financial obligations on land, cadastral record management, registration, land use right certificates, land use rights certificates Certification of ownership of construction works, certificates of land use rights, ownership of houses and properties attached to land, land use right certificates, property ownership attached to land, administrative decisions in land management.
b) Lack of responsibility in management leading to violations of land laws or other acts that harm the interests of the State, the legitimate rights and interests of land users.
c) Violating regulations on collecting opinions, publishing and publicizing information; violating regulations on administrative procedures and order; violating regulations on reporting in land management.
2. The Government shall specify in detail the violations of the law in land management when performing official duties and being subject to disciplinary action as prescribed in Clause 1 of this Article.
Accordingly, irresponsible commune land officials who commit violations in land management while performing official duties will be subject to disciplinary action or criminal prosecution according to current regulations depending on the nature and severity of the violation.
