On the Government Information Portal, Ms. D.T.H in Ho Chi Minh City shared that in 1999, she bought a plot of land with a handwritten sales certificate and had not been granted a red book.
In 2005, Ms. Hien was granted a red book for a part of the land plot. Now she would like to issue the remaining red book with the following content:
The current status is agricultural land being exploited and used normally (not canals).
The land is not in dispute, used stably and long-term.
The location of the land plot belongs to the current housing group according to the approved 1/2000 scale zoning plan.
Measurement documents of the land plot that has not been granted a red book: According to the Map 299 document, it is a canal; Document 02 is a canal; according to the 2003, cadastral map document, there is a land plot.
Ms. Hien asked, is your land eligible for a red book according to the measurement documents of the above land plot? And what are the conditions for being granted a red book for the above land plot?

According to current land law, in case the land user has documents on land use rights as prescribed in Article 137 of the 2024 Land Law, he/she will be considered for a Certificate.
In case the land user does not have documents on land use rights as prescribed in Article 137 but is not subject to the provisions of Articles 139 and 140, the Certificate shall be considered for issuance according to the provisions of Article 138 of the Land Law.
The Ministry of Agriculture and Environment recommends that you contact the competent authority in your locality for guidance and implementation in accordance with the provisions of law.
