According to Clause 1, Article 3 of the 2024 Land Law, the Certificate of land use rights and ownership of assets attached to land is a legal document for the State to confirm the legal land use rights and ownership of assets attached to land of people with land use rights and ownership of assets attached to land.
Assets attached to land are granted certificates of land use rights, ownership of properties attached to land such as houses and construction works attached to land in accordance with the law. Certificate of land use rights, certificates of land use rights, ownership of houses and other assets attached to land in accordance with the relevant laws shall comply with the provisions of this Law with the same legal value as a certificate of land use right, ownership of property attached to the land in this Law.
Accordingly, when children have the same red book as their parents, it means that they have the same right to use land, house ownership and other assets attached to the land, so they have the same rights as parents or have the right according to the ratio of contribution or effort to get land use rights, house ownership rights and other assets attached to the land (part ownership).
- Land users, homeowners and attached assets have specific rights such as:
+ Enjoy the fruits of labor and investment in land.
+ Rights to convert, transfer, lease, sublease, inherit, donate, mortgage land use rights; contribute capital with land use rights.
+ Receive material benefits (mainly money) when leasing or transferring land use rights; leasing or selling houses and other assets attached to land.
+ Compensation when the State reclaims land...
Thus, when children and parents have the same right to use land, house ownership rights and other assets attached to land, they have the right to enjoy benefits from land, houses and assets attached to that land or when parents transfer land use rights or sell houses, they need to have written consent from the child.
Conclusion:
- Children with shared land use rights, house ownership rights and other assets attached to land in case the red book is issued to a household or jointly received a transfer.
- When children share a red book with their parents, children have full rights of land users and owners of assets attached to land such as discussing and deciding on transfers, leases, and enjoying material benefits from the use of land plots, houses and assets attached to land that have been granted a red book.
