On July 29, the National Assembly Standing Committee gave opinions on the draft Law on Housing (amended).
Presenting the Submission on policy orientation for amending the 2023 Housing Law, Member of the Party Central Committee, Minister of Construction Tran Hong Minh said that the amendment and supplementation of the 2023 Housing Law aims to create housing development policies to aim for the goal of everyone having housing, creating equal conditions for people and businesses...
The draft new supplementary law stipulates 4 types of housing and corresponding legal policies for each type of housing, including: Commercial housing types; rental housing; public housing and policy housing.
The draft law also supplements a new Chapter on housing development for lease, which stipulates: Subjects to lease; forms of development through state capital, non-state capital; land, requirements for projects and project investment procedures; preferential policies for investors of projects invested with private capital...
Regarding housing ownership, the draft law supplements the type of limited-term apartment building, the establishment of property ownership rights of people and regulations on handling cases where apartment buildings are subject to demolition.
Adding new types and preferential policies to develop affordable commercial housing and subjects eligible to buy this type of housing.
Supplementing regulations on the development, management and operation of houses for purposes of accommodation (including tourist apartments, tourist villas, office combined apartments, adjacent commercial houses and other types of designations for purposes of accommodation) to manage the proper use of this type of house.
Notably, the draft law supplements the model of hiring professional units to perform a number of tasks of the Apartment Building Management Board to improve the quality of apartment building management and reduce the workload for the Management Board.

The draft Law has reviewed and removed the content of regulations on prohibited acts; some contents overlap with some related laws; removed regulations on the ownership of private houses of foreign organizations and individuals; removed the regulation that the Social Policy Bank lends preferential loans to investors to build social housing and housing for the people's armed forces to be consistent with the credit activities of the Social Policy Bank.
At the same time, the draft Law has thoroughly decentralized power and authority to local authorities, in which 20/21 procedures are under local authority.
Presenting a summary report of opinions on the policy orientation for amending the Housing Law, Member of the Party Central Committee, Chairman of the Law and Justice Committee Phan Chi Hieu said that the Standing Committee of the Law and Justice Committee and agencies of the National Assembly agreed with the necessity of building the Housing Law (amended).
The Chairman of the National Assembly's Law and Justice Committee also proposed that the drafting agency study and supplement a control mechanism for the operation of the Apartment Building Management Board to remove difficulties and inadequacies from the current reality.
Speaking at the conclusion of the meeting, Member of the Party Central Committee, Vice Chairman of the National Assembly Nguyen Khac Dinh proposed to study and clarify mechanisms and policies associated with each type of housing according to new orientations, ensuring clear division of each type of housing (such as social housing, rented-purchased-in-kind housing,... ).
In which, pay attention to reviewing regulations on housing development, avoiding preferential policies, encouraging spreading investment, without focus.
