The order and procedures for resolving land disputes at administrative agencies are stipulated in Part VIII of Decree 151/2025/ND-CP effective from July 1, 2025.
Depending on the subject of the land dispute and the specific case, the authority to resolve land disputes at the administrative agency may vary.
Resolve land disputes at administrative agencies under the authority of:
- Chairman of the People's Committee at the commune level
- Chairman of the Provincial People's Committee
- Minister of Agriculture and Environment
Depending on the order and procedures for land dispute settlement, there will be different times to resolve land disputes.
(1) Time for resolving land disputes of the Chairman of the People's Committee at the commune level
The time for carrying out land dispute settlement procedures under the authority of the Chairman of the People's Committee at the commune level shall not exceed 45 days from the date of receipt of the application for land dispute settlement.
Note:
For mountainous communes, border areas; islands; areas with difficult socio-economic conditions; areas with particularly difficult socio-economic conditions, the implementation time will be increased by 10 days.
(2) Time for resolving land disputes of the Chairman of the Provincial People's Committee
The time for carrying out land dispute settlement procedures under the authority of the Chairman of the Provincial People's Committee shall not exceed 50 days from the date of receipt of the application for land dispute settlement
Note:
For mountainous communes, border areas; islands; areas with difficult socio-economic conditions; areas with particularly difficult socio-economic conditions, the implementation time will be increased by 10 days.
(3) Time for resolving land disputes of the Minister of Agriculture and Environment
The time for carrying out land dispute settlement procedures under the authority of the Minister of Agriculture and Environment shall not exceed 80 days from the date of receipt of the application for land dispute settlement.
