Responding to this question, the Ministry of Agriculture and Environment said that Clause 1, Article 75 of the Law on Geology and Minerals stipulates cases where it is allowed to recover minerals during the renovation and construction of works on residential land and agricultural land without having to carry out procedures for granting mineral exploitation licenses, but must meet the requirements of state management of minerals, land and construction.
- Group III, group IV are minerals used as common construction materials and some other minerals serving domestic production, not classified as strategic or important minerals.
Implementation procedures:
1. ask for permission to build or renovate works according to the provisions of the law on construction (for residential land) or register, apply for approval to renovate land according to the law on land (for agricultural land).
2. Before carrying out the renovation, if there is a possibility of mineral groups III and IV arising in the area, people must notify in writing the People's Committee of the commune where the land is located, along with documents showing the location and volume expected to be recovered.
3. The People's Committee at the commune level coordinates with civil servants in the land - construction - environment to inspect and confirm the recovery of arising minerals.
4. Carry out the recovery of minerals in the correct volume and type of minerals; ensure labor safety, environmental sanitation; pay financial obligations (if any) according to the instructions of the tax authority.
Resolution agency:
- The People's Committee of the commune where the land is located is the agency receiving and confirming the mineral recovery.
- Coordination department: land - construction - environmental civil servant of the People's Committee of the commune.
In short, families when renovating and constructing works on residential land or agricultural land need to simultaneously carry out construction/land procedures and procedures for notification and confirmation of the recovery of group III and IV minerals at the People's Committee of the commune where the land is located, according to the provisions of the 2024 Law on Geology and Minerals and guiding documents for implementation.
