In October 2025, the People's Committee of Khanh Hoa province reported on the progress of removing difficulties and obstacles for investment projects in the area, including 4 projects using offices (public assets) to pay investors under the form of BT (build - transfer) contracts.
4 projects include: Khanh Hoa Medical College (phase 1), anten pillar of Khanh Hoa Radio and Television Station, working headquarters of Khanh Hoa Radio and Television Station and Nha Trang Vocational College.
According to the People's Committee of Khanh Hoa province, these are projects facing difficulties due to contracts signed in violation of regulations and there are no specific instructions on how to pay with public assets for BT projects.
Up to now, investors have mainly proposed solution 2 - payment for headquarters land after reviewing and rearranging public assets; and solution 3 - amending and supplementing contracts to pay with land funds according to the principle of this solution, and at the same time proposing to supplement interest due to State payment delays.
Khanh Hoa Provincial People's Committee said that these projects have contracts that are not in accordance with legal regulations at the time of signing, but can be amended and supplemented by contract appendices without changing the rights and obligations of the parties.
Therefore, the province recommends applying solution 3, not implementing solution 2, because solution 2 still pays investors according to the old contract, not ensuring current legal principles.
Along with that, the province also proposed to supplement similar to solution 6 for cases where investors use loans and generate interest due to the State's delay in paying land funds, to ensure the harmony of interests between the State and enterprises.
Regarding the two anten pillar projects and the working headquarters of Khanh Hoa Radio and Television Station, according to the announcement of the direction of Deputy Prime Minister Ho Duc Phoc during the on-site inspection in Khanh Hoa (April 2025), the Provincial People's Committee is required to study and propose the auction of land use rights at the present time, and at the same time, carry out the settlement of the investment part of the enterprise for payment according to regulations.
The Department of Agriculture and Environment, together with the Land Fund Development Center, are implementing this content under the direction of the People's Committee of Khan Hoa province.
